24) <br /> <br />REPAIR: To restore to a sound and acceptable state of operation, serviceability, <br />or appearance in the determination of the City Building Official. <br /> <br />2 5 ) RODENT HARBORAGE: Any place where rodents live, nest or seek shelter. <br /> <br />26) <br /> <br />27) <br /> <br />28) <br /> <br />SEWER SYSTEM: A functioning sewer connection free from defects, leaks or <br />obstructions with sufficient capacity to drain all fixtures or appliances which <br />feed into ~t. The sewer system, be it municipal or private, must be capable of <br />disposing of sewage in a safe, sanitary, and adequate manner. <br /> <br />U. B. C.: Uniform Building Code. <br /> <br />UNSAFE: As applied to a slructure, a condition or combination of conditions <br />which is dangerous or hazardous to persons or property. <br /> <br />29) <br /> <br />UNSANITARY: As applied to a structure, conditions which are dangerous or <br />hazardous to the health of persons. <br /> <br />30) <br /> <br />WATER CLOSET: A toilet, with a bowl and trap made in one piece, which is <br />connected to an approved water supply and sewer system. <br /> <br />31) <br /> <br />WATER SUPPLY: A functioning plumbing connection free from defects, leaks or <br />obstructions providing a potable, controllable flow of water. <br /> <br />SECTION 110.191E - ADMINISTRATION: <br /> <br />1) <br /> <br />The City Building Official shall administer and enforce the provisions of this <br />ordinance and they are hereby authorized to cause inspections on a scheduled <br />basis or when reason exists to believe that a violation of this ordinance has been <br />or is being committed. <br /> <br />2) <br /> <br />When a City Building Official determines a violation, the Building Official's <br />written evaluation of the deficiencies shall be considered prima facie evidence in <br />any subsequent litigation of a violation under this section. <br /> <br />3) <br /> <br />If any owner, occupant, or other person in charge of a dwelling unit fails or <br />refuses to permit free access and entry to the structure of premises under that <br />person's control for an inspection pursuant to this ordinance, the Building <br />Official may seek a court order authorizing such an inspection. <br /> <br />ARTICLE I1: GENERAL REGULATIONS <br /> <br />SECTION 110.192A - RESPONSIBILITY OF OWNERS: The owner of a dwelling shall be <br />responsible for the maintenance of that structure and for meeting the provisions of this <br />ordinance. Those responsibilities may not be abrogated by a private agreement. <br /> <br />SECTION 110.192B - REMOVAL OF BASIC EQUIPMENT OR FACILITIES: No owner, operator, or <br />'occupant shall cause any facility or equipment which is required under this ordinance to be <br /> <br /> <br />
