CASE # 2 <br /> <br />REVIEW CRITERIA FOR APPROVING AN <br />APPLICANT FOR AN OFF-SALE LIQUOR LICENSE <br /> By: Dave Hartley, City Administrator <br /> <br />Background: <br /> <br />After review by a committee appointed to recommend possible criteria for the issuance of off- <br />sale liquor licenses, the City Council, at its regular meeting of December 27, 1988, adopted <br />Resolution #88-241. Earlier, Ordinance #88-12 was adopted which permitted three rather <br />than two off-sale licenses in the City of Ramsey. The effective date of Ordinance fl88-12 is <br />April 9, 1989. <br /> <br />Applications for the one available license were taken, and the City now has two applicants who <br />appear to qualify based on the criteria established by Resolution #88-241. <br /> <br />One criteria requires that the facility be located in the Urban Area of Ramsey. This is the area <br />that is zoned as the Urban Area and does not necessarily have sewer and water. It is sometimes <br />confused as the MUSA (Municipal Utility Service Area) where utilities are planned to go within <br />the near future. <br /> <br />Another criteria that may need clarification is the requirement that the facility be of new <br />construction (never before having been occupied). Does this mean new construction following <br />the application for permit, or is the emphasis on never before havino been occupied? <br /> <br />Enclosed for your information is Resolution #88-241, City Council meetin, g minutes dated <br />December 27, 1988, Ordinance #88-12, and a map depicting the Urban Area. <br /> <br />Recommendation: <br /> <br />Council action will be to review the criteria and advise Staff regarding the interpretation of <br />policy. <br /> <br />Review Checklist: <br /> <br />City Administrator .
