CITY OF RAMSEY, <br />ANOKA COUNTY, MINNESOTA <br />AGREEMENT FOR <br />PROSECUTION LEGAL SERVICES <br />Whereas the City of Ramsey ("City"), a public body corporate and politic operating as a home rule charter <br />city under the laws of the State of Minnesota and located within the County of Anoka, desires to have <br />certain prosecution legal services provided; and <br />Whereas the City solicited proposals for attorney services for criminal Prosecution legal services <br />(collectively the "Prosecution Legal Services"); and <br />Whereas the council of the City has selected the law firm of Randall, Goodrich and Haag, P.L.C. <br />("Attorney") to serve as city attorney to provide the Criminal Prosecution Legal Services and related <br />services and has authorized a contract between the City and the Attorney; and <br />Whereas the contract between the City and the Attorney is hereinafter referred to as this Agreement. <br />Now, therefore, it is hereby agreed that this document by and between the City and the Attorney, shall be <br />a binding obligation on behalf of all parties named. <br />I. Term. <br />a. This Agreement shall be effective July 1, 2013 through June 30, 2016, inclusive. It shall be <br />renewable, at the City's option, for an additional term or term(s). <br />b. The City or Attorney may terminate this Agreement upon thirty (30) days written notice without <br />cause. Upon termination of this Agreement, the City shall only be responsible for the monthly <br />fee and any additional billings accrued as of the date of termination. <br />II. Scone of Criminal Prosecution Legal Services. <br />The following criminal prosecution legal services shall be provided to the City by the Attorney as a <br />matter of right under the terms of this Agreement: <br />• Prosecution of all non -felony criminal and traffic matters, including: <br />o Petty misdemeanor offenses <br />o Misdemeanor offenses <br />o Gross misdemeanor offenses <br />• Appearance at all criminal or traffic hearings, including: <br />o Arraignments <br />o Bail hearings <br />o Pre-trial hearings <br />o Court trials <br />o Probation violation hearings (as needed) <br />o Contested Omnibus hearings <br />o Jury trials <br />o Sentencing hearings <br />o Motion hearings <br />• Draft complaints <br />• Review of proposed charges <br />1 <br />
