ARTICLE V <br />Improvements Within The Anoka Nature Preserve <br />The City identifies that certain improvements will occur within the Anoka Nature Preserve. The <br />following outlines terms and conditions related to said improvements. <br />Section 5.1. City Financial Contribution. The City shall pay Developer $100,000 <br />towards the riverbank stabilization project to be constructed by Developer as outlined in the <br />Construction Plans. This amount shall be paid to Developer after all improvements within the <br />Anoka Nature Preserve according to the Construction Plans have been completed. <br />Section 5.2. Construction Plans. The Developer shall prepare plans for the grading, <br />stabilization, and reforestation of the river bank along the Rum River. Such plans shall be <br />reviewed by the City of Anoka, Anoka Conservation District and Minnesota Department of <br />Natural Resources. The plans shall include cost estimates. The plans shall be included as part of <br />the Construction Plans. <br />Section 5.3. Grading/Access to Dock System. The Developer shall be responsible to <br />grade an area and provide access to the dock system from the main trail. . <br />Section 5.4. Grading of the Bank. The Developer shall be responsible to grade the bank <br />in accordance with the approved Construction Plans. <br />Section 5.5. Tree Removal/Reforestation. The Developer shall be responsible for tree <br />removal related to the stabilization of the bank and reforestation of the river bank in accordance <br />with the approved Construction Plans. <br />Section 5.6. Trail. The Developer shall be responsible for constructing the main public <br />trail, the public trail between Lots 6 and 7, Block 1, the public trail between Lots 9 and 10, Block 2 <br />and the public trail to the dock system in accordance with the approved Construction Plans. The <br />City shall reimburse Developer for construction costs after an invoice providing the cost <br />breakdown has been provided to, and approved by, the City. The City shall submit <br />reimbursement within 30 days of receipt of the approved invoice. The Developer shall grant the <br />City an easement for trail purposes over the trail between Lots 6 and 7, Block hand trail between <br />Lots 9 and 10, Block 2. <br />Section 5.7 Temporary Irrigation. City shall be responsible for the temporary <br />irrigation of the riverbank stabilization improvements for two years following the completion of <br />construction of said improvements. <br />11 <br />
