Staff recommends the following conditions be placed on the <br />approval of the Preliminary Plat: <br />1. The developer shall enter into a development agreement with the City of Anoka upon final <br />plat approval. <br />2. A final plat must be submitted to the City of Anoka Planning Department and approved by <br />the City Council within 12 months of preliminary plat approval. <br />3. The developer shall comply with the LRRWMO approval and permit for the drainage, <br />grading and erosion control. <br />4. Improvements within the Anoka County right-of-way require necessary County permits. The <br />Anoka County Highway Department Engineering Plan Review process will apply to this site. <br />5. The developer must submit electronic as -built surveys of all homes to the City of Anoka <br />Engineering Department. <br />b. The Developer will need to enter into a storm water facility maintenance agreement with the <br />City as a condition of approval for the plat for long-term maintenance of the stone water <br />system for the site. The City reserves the right to inspect and enforce storm water rules and <br />maintenance of the facilities on the site. <br />7. The developer must provide a performance guarantee in the amount of 1.25 times the <br />estimated cost of grading, parking lot improvements, landscaping and other exterior or public <br />improvements. <br />8. The outdoor private pool and building shall be constructed consistent with the Anoka City <br />Code. The swimming pools shall be protected by a fence, wall or building or other enclosure <br />or any combination thereof, consistent with the Anoka City Code. It will also be owned and <br />maintained by the Homeowners Association. <br />9. All rain gardens shall be owned and maintained by the Homeowners Association. The rain <br />garden will need to be constructed and installed according to current MPCA requirements. <br />10. The storm water outfall to the Rum River would require a DNR permit if it is placed below <br />the Ordinary High Water (OHW) of the river and Minnesota Pollution Control Agency <br />(MPCA) standards for discharges to Outstanding Resource Value Waters shall be met. <br />11. No more than one single-family dwelling with the same exterior configuration can be erected <br />on any five abutting, contiguous, successive or adjoining lots. This shall be approved <br />administratively through the building permit process. <br />
