REQUEST FOR A ZONING AMENDENT TO CHAPTER 9, <br />SECTION 9.11.04 HOME OCCUAPTIONS <br /> CASE OF LONNY MENARD <br /> By: Megan Wald, Associate Planner <br /> <br />Background: <br /> <br />The City Council reviewed the proposed revised Home Occupation Ordinance at the November 3, <br />2003 City Council work session. As you may recall, the current Home Occupation Permit restricts <br />home occupations to the confines of the dwelling, which excludes attached or detached garages. <br />The ordinance also does not allow for employees other than residents that live on the property. <br /> <br />Staff reviewed the following proposed additions to the ordinance with the City Council during the <br />work session: <br /> <br /> 1. Establishes standards for occupations conducted within the dwelling. <br /> <br /> 2. Language has been added to allow businesses-to be operated fi.om an accessory structure <br /> for parcels 3 acres or greater in size and establishes standards for these operations. <br /> <br /> 3. Gives the City Council the flexibility to approve or deny a business operation within a pre- <br /> existing accessory structure that is located on a parcel that does not contain a residential <br /> dwelling. It should be noted that City Code no longer allows accessory structures to be <br /> constructed on a property that does not contain a principal dwelling. <br /> <br /> 4. Establishes a list of specific business operations that may be considered a little more <br /> intensive (i.e. traffic or production of product) for parcels 10 acres in size and greater that <br /> are located within the Rural Developing and Rum/PreserVe areas <br /> <br /> 5. Allows employees, that are not occupants of the residential dwelling. The number of <br /> employees permitted is based on lot size. <br /> <br />Observations: <br /> <br />During the work session, the City Council directed staffto complete the following: <br /> <br /> 1. Include langmge requiring the homeowner to have a vested interest in the business being <br /> operated on the subject property. <br /> <br /> 2. Decreased the number of non-resident employees allowed under the accessory structure <br /> home occupation section of the ordinance. <br /> <br /> 3. Quantified "excessive vehicular traffic." <br /> <br /> 4. Included surrounding density and lot size as a criteria for approving or denying a home <br /> occupation request. <br /> <br />Staff included an intent paragI~h under Principal Dwelling Home Occupation and Accessory <br />Structure Home Occupation sections, which states the homeowner needs to have a vested interest <br />in the business and furthermore states that the City is not interested in creating business-leasing <br />nodes within a residential district. <br /> <br /> <br />
