The number of non-resident employees has been reduced by half; staff is proposing a maximum of <br />3 employees instead of the previously proposed 6 employees on 10+ acres. <br /> <br />The following language has been added to quantify excessive vehicular traffic, "The Home <br />Occupation shall not generate excessive vehicular traffic to the residential neighborhood, <br />which shall be quantified as follows: 2 vehicle trips per hour per standard 8 hour business day <br />or 16 vehicle trips within a 24 hour period. An increase at a rate of 25% is permitted if the <br />subject property gains access from a County, State, or MSA Street. The total traffic Irips <br />permitted includes employees and deliveries." <br /> <br />The following language has been added to both the Principal and Accessory Structure <br />Home Occupation sections within the ordinance; "The operation may not be permitted if the <br />density and lot sizes of the surrounding neighborhood are determined to be too dense and <br />therefore not compatible to the proposed business operation." <br /> <br />Ordinance applied to the Lonrw Menard Situation: <br />The enclosed Home Occupation Ordinance will allow the City Council the ability to review a <br />Home Occupation Permit application request to operate a business from an accessory structure and <br />provides some performance standards. The ordinance further allows the City Council to consider <br />approving a business operation in an existing lawful non-conforming accessory structures that do <br />not have a residential dwelling on the property. These two provisions will allow Mr. Menard the <br />ability to inform potential commercial buyers that they can apply for an Accessory Structure Home <br />Occupation Permit to operate a business and provide some guidelines as to what type of uses will <br />be considered on his 10 acre parcel. <br /> <br />Recommendation: <br /> <br />City Staff is recommending that the City Council introduce the enclosed Home Occupation <br />Ordinance. <br /> <br />Mr. Menard is requesting reimbursement to the $400 Zoning Amendment application fee. It i-k his <br />opinion that since Staff intended to discuss with the City Council and Planning Commission <br />regarding the Home Occupation Ordinance that he should not bear the cost. Staff would <br />recommend a cost sharing approach to his situation as staffhas spent many hours working with Mr. <br />Menard's attorney attempting to work through several different approaches and opinions during the <br />drafting of this ordinance. <br /> <br />Enclosed for your information: <br /> <br /> 1.
