CITY OF RAMSEY <br /> ANOKA COUNTY, MINNESOTA <br />DEVELOPMENT AGREEMENT - VALVISTA ESTATES <br /> <br /> THIS AGREEMENT, made and entered into by and between the CITY OF RAMSEY, a <br />municipal corporation of the State of Minnesota (the CITY"), and EUGENE VALERIO, whose address <br />is 16514 Jaspar Street NW, respectively, (the "DEVELOPER"). <br /> <br />WITNESSETH: <br /> <br /> WHEREAS, the DEVELOPER is the fee owner of the following described property situated in <br />the CITY OF RAMSEY, County of Anoka, State of Minnesota, and legally described as follows: <br /> <br />The West 578.00 feet of the East 644.00 feet of the South 729.25 feet of the Southwest Quarter of <br />the Southwest Quarter, Section 10, Township 32, Range 25, Anoka County Minnesota <br /> <br />Or upon recording: <br /> <br />Lots 1, 2, and 3, Block 1, Valvista Estates, Anoka County, Minnesota. <br /> <br />(the "Subject Property"); and <br /> <br /> WHEREAS, on November 25, 2003, pursuant to Resolution #03-11-, the CITY approved the <br />final plat of the Subject Property which plat is'known as VALVISTA ESTATES (the "Plat") contingent <br />on certain requirements, including DEVELOPER and CITY entering into this agreement; and <br /> <br />WHEREAS, the Plat consists of three (3) lots totaling approximately 9.67 acres; and <br /> <br /> WHEREAS, approval of the Final Plat is given pursuant to the City's Subdivision Code Section <br />9.50.05 (S ubd. 1) entitled "Division or Consolidation of platted Lots". <br /> <br /> WHEREAS, no expenditure of CITY funds will be made until City Code escrow requirements <br />have been fulfilled by the DEVELOPER. <br /> <br />NOW, THEREFORE, the CITY and DEVELOPER agree as follows:' <br /> <br />SECTION I. <br />IMPROVEMENTS <br /> <br />Access to Lots. Lot 3 shall continue to utilize the existing access onto Jaspar Street, Lot 1 will <br />have the option to gain access on either Jaspar Street or 166th Avenue, and Lot 2 will gain access <br />onto 166th Avenue. <br /> <br /> <br />
