Drainage and Utility Easements. The standard 10 foot (5 feet on common property lines) <br />drainage and utility easements shall be dedicated along the perimeter of each of the two lots. The <br />wetland located on Lot 3 must be encumbered with a drainage and utility easement. <br /> <br /> SECTION II. <br />PERMITS AND OCCUPANCY <br /> <br />Requirements for Building and Occupancy Permits. No building permit for any lot in the Plat <br />shall be issued until: (a) a Class 5 driving surface is installed to within 300 feet of the structure; <br />(b) a Certificate of Survey, includihg that survey information required by the CITY, has been <br />supplied to the City Building Official upon his/her request; and (c) all the financial guarantees <br />required by the CITY have been satisfied. No occupancy permit for any lot in the Plat shall be <br />issued until: (a) all utilities are in place, operational and accepted by the CITY; and (b) landscape <br />trees, or escrow for same, has been provided. <br /> <br /> SECTION III <br />PARKS, TRAILS, STORMWATER, LANDSCAPING <br /> <br />Park Dedication. The Plat is in the Trott Brook Park District. The DEVELOPER shall satisfy <br />the park dedication requirement for the Plat with a cash payment. The existing homestead is <br />exempt from this fee. Therefore a payment in the mount of Three Thousand Six Hundred Dollars <br />and no cents ($3,600.00) shall be paid to the City prior the City releasing the Final Plat for <br />recording. <br /> <br />Trail Development Fee. The City has enacted a trail development fee in the amount of Four <br />Hundred Seventy Five Dollars and no cents ($475.00) per lot. Lot 3, the existing homestead, is <br />exempt from this fee. Therefore, a payment in the amount of Nine Hundred Fifty Dollars and no <br />cents ($950.00) shall be paid to the City prior to releasing the Final Plat for recording. <br /> <br />Stormwater Management Fee. The CITY has enacted a Stormwater Management Fee in the <br />amount of Three Hundred Seventy Five Dollars and no cents ($375.00)per unit. Lot 3, the <br />existing homestead, is considered by the CITY to be exempt from this fee. The amount of <br />Stormwater Management Fee due on the Plat is Seven Hundred Fifty Dollars and no cents <br />($750.00). This amount shall be paid to the CITY prior to releasing the Final Plat for recording. <br /> <br />Tree Planting Prior to issuance of a Certificate of Occupancy, the DEVELOPER shall plant two <br />new two-inch diameter overstory trees in the front lot of Lot 1 and 2, Block 1, Valvista Estates. <br />One tree shall be deciduous (min. 2.$" d.b.h.) and one shall be coniferous (min. 6' in height). In <br />addition, the DEVELOPER shall do the following: <br /> <br />a) <br /> <br />Minimizing the impact of construction on trees in accordance with Minnesota Extension <br />Service publication "Protecting Trees From Construction Damage" (Publication #NR-FO- <br />6135-S). <br /> <br /> <br />
