hereto agree as follows: <br /> <br />13. DEVELOPER, at the time of the recording of the plat of <br /> <br />the future phase, shall convey to the CITY by Warranty Deed, a <br /> <br />perpetual easement to the following property located within the <br /> <br />future phase and/or the Northfork PUD: <br /> <br />A 35.00 foot wide permanent easement for trail purposes <br />over, under and across the property as generally shown <br />on Exhibit "B" and legally described on Exhibit "C" <br />attached hereto and incorporated herein. <br /> <br />b. A 75.00 foot wide permanent easement for trail purposes <br /> over, under and across that certain property lying south <br /> of Lake Itasca as generally shown on Exhibit "B" and <br /> legally described on Exhibit "D" attached hereto and <br /> incorporated herein. <br /> <br /> \ <br />The use of the permanent easements described on Exhibits "C" <br />and "D" herein shall be those uses generally permitted on <br />multi-use trails in the CITY as established by the CITY from <br />time to time but specifically excluding motorized vehicular <br />uses. <br /> <br />14. The 60.00 foot wide permanent easement for trail purposes <br /> <br />described in Paragraph 1 of the AGREEMENT shall be conveyed by the <br /> <br />CITY to the DEVELOPER and in its place DEVELOPER shall convey <br /> <br />the CITY a 75.00 foot wide permanent easement for multi-use trail <br /> <br />purposes over, under and across that certain property lying north <br /> <br />of the park land previously conveyed to the CITY and as generally <br /> <br />shown on Exhibit "B" and which 75.00 foot wide permanent easement <br /> <br />is legally described on Exhibit "E" attached hereto and <br /> <br />incorporated herein. <br /> <br />The use of the permanent easements described on Exhibit "E" <br />herein shall be those uses generally permitted on multi-use <br />trails in the CITY as established by the CITY from time to <br />time but specifically excluding motorized vehicular uses. <br />DEVELOPER does reserve a single 50.00 foot wide permanent <br />easement crossing over the said 75.00 foot wide permanent <br />easement described on Exhibit "E" at right angles.
