easement reserved shall be for the purpose of providing access <br /> across the trail in order to permit homeowners access to the <br /> southerly area of Lake Itasca. The exact legal description <br /> of said 50.00 foot wide access easement will be determined at <br /> the time that the 75.00 foot wide easement is conveyed to the <br /> CITY. <br /> <br /> Fee title to any portion of the 75.00 foot wide permanent <br /> easement described on Exhibit "E" above shall be conveyed to <br /> the CITY upon the replatting of any portion of Outlot C, <br /> Northfork if any portion of the said Plat abuts the easement <br /> described on Exhibit "E" Notwithstanding the above, fee <br /> title to the said 75.00 foot wide easement describied on <br /> Exhibit "E" shall be entirely conveyed to the CITY no later <br /> than July 1, 1992. <br /> <br /> 15. The CITY shall not allow the storage or parking of horse <br />trailers or the unloading or loading of horses on any of the <br />properties adjacent thereto by the terms of the AGREEMENT or ~he <br />ADDENDUM or conveyed to the CITY unless otherwise mutually agreed <br />by the parties hereto. <br /> <br /> 16. That prior to recording of any final plat for any portion <br />of the Northfork PUD property lying westerly of Andrie Street, the <br />DEVELOPER shall pay to the CITY, the sum of $500.00 per lot created <br />within said plat. <br /> <br /> 17. In addition to the cash payment required by Paragraph 16 <br />above for the Northfork PUD property lying westerly of Andrie <br />Street, the DEVELOPER and the CITY shall, on or before the platting <br />of no more than 125 lots in said property lying westerly of Andrie <br />Street, determine the location of the two (2) one acre neighborhood <br />parks required by Paragraph 5a of the AGREEMENT. It is understood <br />that such parks may be located in areas other than as indicated in <br />the AGREEMENT and that such two acres could be consolidated into <br />one park, upon mutual consent of the CITY and DEVELOPER. <br /> <br /> <br />
