The CITY, at its sole expense shall cause to <br />be constructed a minimum of four (4) street light <br />stardards for lighting along the Front Street and <br />Sunfish Lake Boulevard right-of-way using underground <br />wiring and metal poles. The street lighting will be <br />installed on the same schedule as ~he s~reet <br />:onstruction described above· The LAND uWNERa <br />Property will NOT be specially assessed for any benefit <br />the LAND OWNERS' Property may receive from said street <br />lighting improvement, The standard of lighting shall De <br />at the sole discretion of the CITY and the CITY shall <br />DaY for the electricity used by the street lights. <br /> <br />Front Street and Sunfish Lake ~oulevard Access· The <br />~ITY will construct a maximum of rive (5) private <br />residential accesses onto Front Street from LAND OWNERS' <br />Property lying south of Front Street and a maximum of <br />two (2) private co~americal accesses onto Front Street <br />frown LAND OWNERS' Property lying north of Front Street· <br />The CITY will also construct one (1) private commercial <br />access onto Sunfish Lake ~oulevard trom the LANP OWNeRs' <br />Property lying wes~ of Sunfis~ Lake ~oulevard. The <br />location of the said accesses shall be those locatiuns <br />as designated by the LAND OWNERS in accordance with the <br />LAND OWI~ERS development plan. <br /> <br />Storm Sewer. The CITY will install at its own expense a <br />storm sewer s.ysetm adequate in size ~o provide an outlet <br />to the M,ississippi River for all of ~he LAND <br />Property, Front -~treet and Sunfish Lake ~oulevard. Said <br />storm sewer system will be designed and constructed by <br />the CITY so as to accommodate LAND U~'NERS' future <br />residential and commercial development of LA~'~D OWNEKb' <br />Property· THE CITY WILL ~OT mOW UR IN Tm£ FUTUR~ <br />SPECIALLY ASSESS LAND OWNERS' PROPERTY FOR A~Y BENEFIT <br />IT MAY RECEIVE FROM SAiD STORM ~E'~ER SYSTEM DESCRIBED <br />HEREIN. The design of the s~orm sewer system wilt be <br />done exclusively by the CITY, except thac ~he LAND <br />OWNERS shall have input as to the precise placement of <br />the storm sewer pipe on the LANg OWNERS' Property. The <br />general location of the storm sewer pipe shall be such <br />that it commences at the north edge of Front Street ~hen <br />south on the LAND OWNERS' Property to :he pipe's outlet <br />at the Mississippi River. The precise loca:ion of ~he <br />storm sewer pipe shall be made by LAND UNNERS in <br />conjunction with the future development of LANU OWNERs' <br />Property, and the storm sewer easement as described in <br />Paragraph 1. above. The storm sewer system shall be <br />constructed in conjunction with the Front street <br /> <br /> <br />
