Case % 19 <br /> <br />COMPREHENSIVE PLAN AMENDMENT/MUSA 2000 & 1990 EXCKANGE <br /> By: Merland Otto <br /> <br />Background: <br /> <br />city Council directed staff at the March 28, 1989 Council meeting <br />to proceed with negotiations with Metro Council so that an exchange <br />of the MUSA could move forward. <br /> <br />After consultation with MC staff, the city formally requested a <br />temporary delay on action on the MUSA 2000 amendment submitted <br />January 26, 1989. This request was transmitted by letter on April <br />11, 1989. <br /> <br />A separate amendment was prepared which proposed an exchange of <br />approximately 165 acres. The proposed exchange allowed for Cedar <br />Hills, Chestnut Hills, and Juniper Ridge to be included in the 1990 <br />MUSA and removes Ramsey Terrace, Flintwood Hills, Pondvaie Estates, <br />and an area east of Pondvale Estates from the 1990 MUSA as shown <br />on the attached Figure. <br /> <br />The document requesting the exchange was submitted to MC on April <br />17 after meeting with MC staff on April 14, 1989. MC has indicated <br />that their review and action should be completed in 30 to 60 days. <br /> <br />On' Nay 8 we were informed by MC staff that the proposed land <br />exchange was "a dead amendment" and recommended that we withdraw <br />the amendment in favor of a different land exchange or amendment. <br /> <br />On May 9, we requested that the amendment be withdrawn, and that <br />review action on the original submittal be reinstated with a July 1 <br />review date. <br /> <br />On May 15, I discussed the status of the review with Steve <br />Schwanke, MC Planner and Review Coordinator for the project. In <br />order to meet a July 1 deadline, MC needs to receive a response <br />from the City by June 1. We have not received formal written <br />comments from MC staff as of 5/16 but anticipate receiving them by <br />5/24/89. <br /> <br />Discussions with MC staff indicate that MC's_~rma_~ ~ positions <br />probably be: <br /> <br />1) <br /> <br />4) <br /> <br />Implement 4/40 acre zoning. <br />Ordinance needs to be in place unless can assure MC by <br />resolution that an ordinance will be put in place upon ~JSA <br />expansion. <br />May be able to justify additional MUSA expansion with strict <br />4/40 acres ordinance. <br />Connection of existing development within MUSA to regional <br />sewer system. <br /> <br /> <br />
