CASE <br /> <br /> REQUEST TO VACATE DRAINAGE <br /> EASEMENTS ON LOT 3, BLOCK 5, WHISPERING PINES ESTATES <br /> Case of Richard and Wendi Jarson <br /> By: Pete Raatikka, City Engineer and <br /> Mark Banwart, Communit5, Development Director <br /> <br /> Richard and Wendi Jarson are requesting that the City vacate <br />the drainage easement which covers the entire Lot 3, Block 5 of <br />Whispering Pines Estates. <br /> <br /> As indicated in a letter from Mr. Charles M. Seykora to the <br />City Attorney dated June 12, 1989, the Jarsons purchased the lot, <br />which was a tax delinquent parcel, obtained a building permit and <br />built a home on the property. <br /> <br /> Based on a review of the drainage in the area by the City <br />Engineer as discussed in his letter of June 21, 1989, there are <br />several alternative solutions to handling the drainage if the <br />easement is to be vacated. The best solution to prevent future <br />flooding would be to construct a storm sewer to Lake Itasca. <br />However, this may be the most costly alternative. Other <br />alternatives are the constructing of a ponding area or the <br />construction cf dry wells. These alternatives may not provide the <br />same protection from flooding as the storm sewer outlet. <br /> <br />Enclosed are the following items: <br /> <br />Letter dated June 1, 1989 to Richard and Wendi Jarson from <br />Mark Banwart. <br /> <br />Letter dated June 12, 1989 to Er. William K. Goodrich from <br />Charles M. Seykora. <br /> <br />Letter dated June 21, 1989 to the City Council from Peter R. <br />Raatik~a. <br /> <br />Quit Claim Deed dated October 5, 1973 showing the drainage <br />easement over Lot 3, Block 5, ~ispering Pines Estates. <br /> <br />Recommendation: <br /> <br />We would recommend that the City Council receive input at the <br />public hearing for vacation of the easements and discuss the <br />solutions with the City Staff and the Jarsons. Based on the input <br />and discussions the city Council should direct City Staff to <br />prepare findings of fact if they decide to vacate the easement. <br />A solution to the drainage problem and the financing of the <br />solution will have to be determined. <br /> <br /> <br />
