We are aware of a legal concern relating <br />to access road right of way between Lots 1 and 2. The Applicant <br />has since obtained a 20 year access easement from Commercial <br />Asphalt Co. for use of a 30' access drive. <br /> <br />Setback Requirements <br /> <br />Minimum rear yard setback in the I-1 district is 35'. The <br />principle structure was constructed encroaching into the setback <br />by as much as 13'. A variance was not granted at that time and it <br />should be recorded as a pre-existing condition under this process. <br />New building construction for the baghouse is proposed which would <br />comply with setback requirements. <br /> <br />Site Pavinq <br /> <br />Ail parking and storage areas are proposed to be either concrete <br />or bituminous surfaced. Pavement sections were not detailed. The <br />access drive on the south is to be bituminous paved. <br /> <br />222.
