CASE # 13 <br /> <br />REQUEST FOR A CONDITIONAL USE PERMIT TO MAINTAIN <br />()NE ADDITIONAL DELIVERY TRUCK FOR A 1tOME <br />FIREWOOD SALES BUSINESS; CASE OF ARNOLD KLAR <br /> By: Planning Assistant Sylvia Frolik <br /> <br />Background: <br /> <br />As you recall, on April 25 City Council reviewed Mr. Klar's request for a conditional usc permit <br />amendmen! to have one additional deliver), truck on his property at 16020 Potassium Street N.W. <br />relating to the firewood business. In addition, Mr. Klar requested that the accesso%, equipment for <br />the firewood business, that has been in use on the property since the issuance of the conditional <br />use pen'nit, also be listed on the amended permit. In response to Mr. Klar's request, Council <br />expressed concern that the existing conditional use permit is in violation by the firewood being <br />stacked in the side yard rather than the rear yard. Council also expressed concern with the size of <br />the operation and fire safety features. Council then amended and adopted the findings of fact and <br />tabled further action, directing City Staff to mee~ with Mr. Klar to draft a conditional use permit <br />amendment that would address operation size and fire safety features in addition to allowing for an <br />additional deliveu' truck. <br /> <br />On Ma5, 1, Fire Chief Bruce Hoeke and Planning Assistant Frolik inspected the Klar property. <br />Although the U shape woodpile formation serves as the best alternative for keeping the equipment <br />and operation from public view, Chief Hoeke indicated that in it's present quantity it would be a <br />major task for the fire department to deal with in the event of fire. The Fire Chief recommended <br />that no woodpiles exceed 50 cords. <br /> <br />Planning Assistant Frolik then proposed 3 options for stacking the wood in accordance with Chief <br />Hoeke's recommendation. Those options were to be considered at the Ma), 9, 1989 Cit-), Council <br />meeting. Mr. Klar contacted City Staff and indicated that the woodpile options presented were not <br />workable for him and requested additional time to negotiate a woodpile footprint with Ms. Frolik <br />and Mr. Hoeke. On May 9, Council tabled action on Mr. Klar's case. <br /> <br />Ms. Frolik and Mr. Hoeke have met with Mr. Klar and arrived at a proposed woodpile footprint <br />that is a~eeable to Mr. Klar from an operations aspect and to Mr. Hoeke from a fire safety aspect. <br /> <br />With regard to the original conditional use permit term requiring the storage of firewood in the rear <br />yard, City Staff is of the opinion that storage of the firewood in the side yard best accomplishes <br />buffer/ng the operation from public view. <br /> <br />Observations: <br /> <br />The following items are enclosed for your infom-~ation. <br /> <br />a) <br />b) <br />c) <br /> <br />d) <br />e) <br /> <br />Site location map <br />Copy of conditional use permit issued in 1984. <br />Findings of Fact/ff)246 adopted on April 25, 1989 relating to the request for an <br />mended conditional use permit. <br />Proposed woodpile footprint (Figure A) <br />Proposed amended conditional use permit <br /> <br />Recommendation: <br /> <br /> <br />
