CASE

REQUEST FOR CONDITIONAL USE PERMIT TO EXPAND
RAMSE'I' AUT() SALES; CASE OF ROBERT & LOUIS WOJCIK
By: ]'lanning Assistant Sylvia lrrolik

Background:

On May 2, 1989, the Planning and Zoning Commission conducted a public hearing regardiz~g the
Wojcik request to expand Ramsey Auto Sales. During the case discussion, it was noted that the
applicants arc in violation of their existing conditional use permit and the case was tabled pending
submission of a site plan addressing the entire site as proposed.

On May 5, 1989, the Planning Ass:~stant issued a letter to the Wojciks's suggesting that they hire a
professional landscape architect to prepare a site plan and in the interim, bring their existing facilitd,
into compliance.

On July 18, 1989, the Planning and Zoning Commission reviewed the site plan and tabled action
until the following is provided:

a)

A report from City Staff regarding the status of compliance with the current
conditional use pemuit.

b)

A recommendation from the City Attorney regarding suggested wording for a
conditional use permit term that would require the applicants to provide financial
security to be used in mitigating the cost of enforcing the conditional use permit.

c)

d)

Correction of deficient items on the site plan (septic system location, alternate septic
system location and indication of number of employees at the site).

Certified lot survey.

Community Development Technician Steve Lutmer inspected the subject property on July 25, 1989
for compliance with the existing conditional use permit. His comments were submitted to Ms.
Frolik and her report is enclosed. That report indicates that there were 3 vehicles encroaching on
the proposed expansion lot; those vehicles were removed by August 1. City Attorney Goodrich
has determined that the City does not have the author/ty to requke £mancial security for conditional
use permit enforcement activities. Mr. Goodrich's memo is also enclosed. The site plan was
corrected to indicate location of existing and alternate septic system locations and number of
employees on the site. A reduced version of the certified lot survey is enclosed.

Observations:

The site plan indicates that the 3 parcels involved ~411 accommodate a total of 126 display vehicles
and 14 customer/employee parking spaces. The site plan indicates improvements that will
eliminate the bituminous encroachment onto the Cry. Rd. #56 right-of-way. The site plan also
indicates removal of the easterly access onto Hwy. #10; this is in accordance with the current
conditional use permit. In addition, the site plan proposes to make improvements to what would
be the center and western most driveways from the 3 parcels onto Hwy. #10. The applicants
submitted the site plan to Mn/DOT and received approval for two accesses onto Hwy. #10. The
City Engineer has recommended that the center driveway not be improved since the parcels can be
served by the westerly driveway. The site plan proposes B6 type curbing and the City Engineer is
recommending type B612.
