This guarantee shal; be in the form ¢,~ cast-, or City <br />approved Letter of Credil in the amount of Ninety Thousand Si>. Hundred Dollars <br />($90,600.00), which amounts to 125% of the Engineer's eslimaied cos1 for such <br />improvemenls. In addition to the Letter ol Credit, the Developer shall posl s <br />maintenance guarantee at the time o! the completion o; thc improvements in the amoun', <br />of Ten thousand dollars (S;IO,ODO.OD). This security shal; be deposited with 1he Oily in <br />the form of a cash escrow or a Letter of Credil in g form to be acceptable 1o the City. <br />This securily shall be held b), the Cil), tot One (1)),ear from the date o! final acceptance <br />ot the improvements. <br /> <br />GRADING AND DRAINAGE PLAN. The Developer shall compl), with grading and drainage <br />plans submilted to and approved by the City Engineer. <br /> <br />TREE REMDVAL/DISEASEDTREECOf',r'FROL. The Developer shall prevent the imroducfion <br />and spread of tree disease into the residue tree populations of the subdivision and <br />adjoining properlies and to reduce the impacts of construclion on the residual properly <br />of the subdivision and adjoining properties. The Developer shall: <br /> <br />Inslall physical barriers such as snow fence around trees that are to remain (the <br />fencing will be al least ten feet (10') from the remaining trees; <br /> <br />All equipment operators will carry a can of tree wound dressing and will apply <br />immediately to damaged trees if wounding occurs; <br /> <br />Trees will only be skidded against other lrees that are to be removed. Trees in <br />the middle twenty feet (20') of road easement will be removed first, with <br />remaining trees to be removed to be skidded toward the middle of the road <br />easement. <br /> <br />CONSTRUCTION SITE DEBRIS. The Developer shalI adhere to Ordinance No. 89-11: An <br />Ordinance Regulating the Dumping of Garbage, Refuse, Site Development and <br />Construction Debris. <br /> <br />STAGE II IMPROVEMENTS. The Developer shall be re,.quired to complete Stage I1 <br />Improvements (e.g., sealcoating and street/traffic signs) as provided in Section 170.03 <br />of the City Code. In addition, the Developer shall make advance payment to the City for <br />these improvements. This advance payment shall be in the form of a cash deposit in the <br />amount of Three Thousand Three Hundred Doliars (g3,300.00) which is 100% o4 the <br />City Engineer's estimate. The City shall retain the interest. The advance payment shall <br />be provided to the City at the time prior to the recording of the plat. <br /> <br />BUILDING PERM!TS. The Developer agrees that in compliance with the City Code, no <br />building permits for any lot in the plat shall be issued until the financial guarantees as <br />described above have been provided and that all grading and class five gravel has been <br />plaid on the roads. <br /> <br />DEVELOPMENT AGREEMENT, The Developer agrees to enter into a Development <br />Agreement with the City of Ramsey. <br /> <br /> <br />
