1989, and recommended the Developer to proceed to the preliminary plal stage; and WHEREAS, the Ramsey Park and Recreation Commission met on March 989, and recommended that cash be used to satisfy park dedication requirements; and WHEREAS, the Ramsey Plannin~ and Zoning Commission met on May 2, 1989, and recommended approval of the preliminary pla; o! Northtork 3rd Addilion contingen~ upon compliance to the City; and WHEREAS, the Ramsey City Counci! met on May 23, 1989, and approved the preliminary plat for the Northlork 3rd Addition. NOW THEREFORE, BE It RESOLVED, THAT THE CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF I~INNESOTA, GRANT FINAL PLAT APPROVAL FOR NORTHFORK 3RD ADDITION CONTINGENT UPON THE FOLLOWING: MARKETABLE TITLE. The Developer providing proof of marketable title for the property Io the City of Ramsey. PARK DEDICATION REQUIREMENTS. Park dedication shall be satisfied pursuani to the Northtork PUD Addendum to Park Dedication Agreement (dated May 9, 1989) and Northfork PUD Park Dedication Agreemenl (dated February 19, 1987), whereby Outlot D and Outlot E are dedicated to lhe City tot park purposes. IMPROVEMENTS. The Developer will construct improvements shown on the plans as directed by the City Engineer, in accordance with lhe City standards and specifications. These improvements include the construction of the street within the plat known as 162nd Lane Northwest, 163rd Lane Northwest and Wolverine Street Northwest; including bituminous surfacing and related ditches, grading, backslopes, drainage and seeding. The Developer shall restore all disturbed area as specified by the City Engineer. The Developer shall also provide erosion control measures during construction. Said improvements shall be completed on or before June 1, 1990 for Phase I, September 1, 1990, for Phase II and November 1, 1990, for Phase II1. the Phase I, 11 and 111 areas are shown on Exhibit A, attached 1.o and made a pad. thereof of this Agreement. ~INAN01AL GUARANTEE. The Deveioper shall provide a financial guarantee for the construction of these improvements. This guarantee shall be in the form of cash or City approved Letter of Credit in the amour, t of Sixteen Thousand Seven Hundred Dollars ($~6,700) tot Phase I, Eighty Three Thousand Dollars ($83,000) for Phase I] and Thirty Five Thousand Dollars ($35,000) for Phase ]]1, which amounts to 125% of the Engineer's estimated cost for such improvements. In addition 1o the Letter of Credit, the Developer shall post a maintenance guarantee at the time of the completion of the improvements in the amount of Ten thousand doliars ($10,000.00). This security shall be deposited with the City in the form of a cash escrow or a Letter of Credit in a form to be acceplable to the City. This security shall be held by the City ior One (1) year from the date of final acceptance of the improvements. GRADING AND DRAINAGE PLAN. The Developer shall comply with grading and drainage plans submitted to and approved by the City Engineer.
