The Developer shall prevent the introduction <br />and spread of tree disease into the residue tree populations of the subdivision and <br />adjoining properties and to reduce the impacts of construction on the residual property <br />of the subdivision and adjoining properties. The Developer shall: <br /> <br />Install physical barriers such as snow fence around trees that are to remain (the <br />fencing will be al leas1 ten feel (10') 1rom the remaining trees; <br /> <br />All equipment operators will carry a can of tree wound dressing and will apply <br />immediately to damaged trees if wounding occurs; <br /> <br />Trees will only be skidded against other trees that are to be removed. Trees in <br />the middle twenty feet (20') of road easemenl will be removed first, with <br />remaining trees to be removed to be skidded toward the middle of the road <br />easement. <br /> <br />G <br /> <br />CONSTRUCTION SITE DEBRIS. The Developer shall adhere to Ordinance No. 89-11: An <br />Ordinance Regulating the Dumping of Garbage, Refuse, Site Development and <br />Construction Debris. <br /> <br />STAGE II IMPROVEMENTS. The Developer shall be required to complete Stage II <br />Improvements (e.g., sealcoating and street/traffic signs) as provided in Section 170.03 <br />of the City Code. In addition, the Developer shall make advance payment to the City for <br />these improvements. This advance payment shall be in the form of a cash deposit in the <br />amount of Four Thousand Three Hundred Dollars ($4,300.00) which is 100% of the <br />City Engineer's estimate. The City shall retain the interest. The advance payment shall <br />be provided to the City at the time prior to the recording of the plat. <br /> <br />BUILDING PERMITS. The Developer agrees that in compliance with the City Code, no <br />building permits for any lot in the plat shall be issued until the financial guarantees as <br />described above have been provided and that all grading and class five gravel has been <br />placed on the roads. <br /> <br />Jo <br /> <br />.D~GLO~MENTAGREEMENT.
