Failure cf the City Council and subdivider to reach <br />agreement regarding the matters in Sections !?0.0~i through <br />170. 069 above shall constitute denial of the preliminary plat. <br /> <br />E>~CEPTIO~¢S <br /> <br />In the case of a request to divide a lot which is a part of <br />a recorded plat where the division is to pe.~it the adding cf <br />a parcel of land to an abutting lot which does not create a <br />new buildable lot, the subdivider shall be exempt from <br />complying ~ith an}' procedural requirements cf this ordinance. <br /> <br />APPLICATION TO }~iNO~ SUBDiViSiONS <br /> <br />In the event of a minor subdivision, the provisions of this <br />Chapter shall apply to the new lots being created rather than <br />the gross area being subdivided. <br /> <br />APPL!CATIO?~ TO RESUBDiViSION <br /> <br />In the event cf a resubdivision of a parcel for which <br />par)[ dedication re~airements have previously been met, <br />no additional par)[ dedication re~_~uirements shall be <br />imposed as a result cf the resubdivision providing the <br />overall densltS~ of development of the parcel remains the <br />s~me as the density allowed under the zoning in effect <br />at the time cf %he inisia! s-'~bdivision. <br /> <br />In the event ~ <br /> ..~at park dedication re~airements ~ere met <br />~-ou~h the use of a fee Der dwel!inc unit cr based on <br />~he value cf the i~rovement, addi~icna! park deSicaticn <br />shall be made for each new lot created under <br />resubdivis~ <br /> <br />The par)[ dedication fee shall be based on the specified <br />contribution per dwelling unit for residential properties <br />resulting frcn the res'abdivision. <br /> <br /> <br />
