Goodrich, City Attorney <br /> <br />BACKGROUND: <br /> <br />On April 25, 1989, the Council adopted Ordinance 89-8 which is an <br />ordinance regulating the issuance of off-sale liquor licenses. <br />Section 130.0511(8) of Ordinance 89-8 states in part as follows: <br /> <br />No off-sale license shall be granted unless the proposed <br />business is located in an area zoned to permit such a <br />land use and unless the prDposed business is located <br />within the city's urban area, which, urban area is as <br />designated on the City's official zoning ~ap. (Emphasis <br />added). <br /> <br />The centerline of County Road 83 is the westerly boundary line of <br />the urban area. Lyle Hager and Brad Dahl, representing ADH <br />Armstrong Liquors, desire to construct and operate an off-sale <br />liquor store west of County 83 adjacent to Brooks Superette. This <br />site is not within the urban area, and therefore an ordinance <br />amendment would be required in order to permit this site.
