CASE <br /> <br />ADOPT ORDINANCE ESTABLISHING <br />BUILDING CODE BOARD OF APPEALS <br />By: David Hartley, City Administrator <br /> <br />Background: <br /> <br />The Uniform Building Code Section 204 requires a local unit of government to-establish an <br />Appeals Board to handle situations where the interpretation of the Building Code is challenged. <br />The City of Ramsey, to date, has not established such an Appeals Board and the City is faced with <br />a r~lUCSt to process an appeal. Therefore, at thc City Council's special meeting of September 5, <br />1989, an ordinance was introduced to establish the Ramsey Building Code Board of Appeals. Thc <br />proposed ordinance addresses the membership, organization, and rules of procedure for such a <br />board. <br /> <br />The Board of Appeals provides for a method to challenge the Building Official's interpretation of <br />the City's Building Code, but not a challenge of the Building Code itself. Since the City of <br />Ramsey has adopted the State of Minnesota Building-Code, challenges to the content of the <br />Building Code must be addressed to the Department of Administration. Similarly, since the State <br />of Minnesota adopts portions of the Uniform Building Code, appeals to the content of the Uniform <br />Building Code must be channeled through such organizations as the ICBO (International Council <br />of Building Officials). <br /> <br />By adopting the Uniform Building Code the City Council has a~eed to establish an Appeals Board. <br />However, the content of the proposed ordinance may or may not meet the satisfaction of the City <br />Council.
