M E M O RA N D U M

TO:

Ramsey City Council

FROM:

William Goodrich, City Anomey

RE:

Bison Street N.W. Improvement

DATE:

September 7, 1989

On August 29, 1989 at a public hearing on the improvement of Bison Street N.W.,
a discussion was held on a stipulated court agreement between the City and Leon~
E. Hinton and Lorraine D. Hinton.- That agreement is dated June 4, 1982
("Agreement"). For your information, I am enclosing a copy of the Agreement.

I have reviewed the Agreement together with two related documents and
correspondence I have in my file on this subject. It is my opinion that the
Agreement does not bind the City to paying for any part of the improvement from
the City's general fund.

The one exception is that the Agreement does specifically provide that the City pay
the costs of vacating the existing roadway when the road is placed in its final
location.

WKG:kaj
