DEVELOPMENT AGREEMENT <br /> <br /> CITY OF RAMSEY <br />ANOKA COUNTY, MINNESOTA <br /> <br />Development agreement by and between the City of Ramsey, Minnesota ("City') and Joel F. <br />Nelson and Louis Wilhelmi ("Developers"). <br /> <br />WITNESSETH: <br /> <br />WHEREAS, Joel F. Nelson and Louis Wilhelmi, hereafter referred to as "Developers', have <br />properly applied for plat approval on the following described property located in the City of <br />Ramsey: <br /> <br />The Northwest Quarter of lhe Northwest Quarter of Section 7, Township 32, Range 25, <br />Anoka County, Minnesota, and the East Portion of the South thirty three feet (33') of the <br />Southwesl Ouarter of the Southwest Quarler of Seclion 6, Township 32, Range 25, Anoka <br />County, Minnesota. <br /> <br />WHEREAS, on July 10, 1989, the Ramsey Planning and Zoning Commission reviewed the sketch <br />plan. Mr. Wilhelmi stated he was willing to dedicate all the easements necessary for the <br />extension of 173rd. Avenue Northwest. In addition, the Planning and Zoning Commission <br />requested reconsideration on his recommendation in Item #5 regarding Lot Orientation. The <br />Planning and Zoning Commission approved the sketch plan for Evergreen Estates; and <br /> <br />WHEREAS, on July 13, 1989, the Ramsey Park and Recreation commission approved the sketch <br />plan for Evergreen Estates Addition and that park dedication be satisfied by cash. <br /> <br />NOW THEREFORE, BE IT RESOLVED, that the City Council of the City of Ramsey, Anoka County, <br />State of Minnesota, as follows: That final plat approval (Resolution # 89-07- ) of Evergreen <br />Estates Addition is granted contingent upon the following: <br /> <br />MARKETABLE TITLE. The Developer providing proof of marketable title for the property <br />to the City of Ramsey. <br /> <br />IMPROVEMENTS. The Developer shall construct improvements shown on the plan as <br />directed by the City Engineer, in accordance with City standards and specifications. <br />These improvements include the extension of 173rd Avenue N.W. and temporary cul-de- <br />sac within the plat and includes shaping the street and related ditches, grading, <br />backslopes, drainage, and seeding. The Developer shall be responsible for any expenses <br />associated with the construction of these improvements. The Developer shall restore all <br />disturbed areas as specified by the City Engineer. The Developer shall also provide <br />erosion control measures during construction. Said improvements shall be completed on <br />or before November 1, 1989. <br /> <br />FINANCIAL GUARANTEE. The Developer shall provide a financial guarantee for the <br />construction of lhese improvements. This guarantee shall be in the form of cash or City <br />approved Letter of Credit in the amount of Three Thousand Seven Hundred Fifty Dollars <br />($3,750.00), which amounts to 125% of the City Engineer's estimated cost for such <br /> <br /> <br />
