DEVELOPMENT CONTRACT - BECKER ROLLING PINES ADDITION IMPROVEMENTS Access to Lots. Access to both lots of the Plat may be directly onto Variolite Street N.W. because of the power line easement which crosses the Plat. However, when the future extension of a North/South Street (Sapphire Street Northwest) is completed, access onto Variolite Street N.W. shall be eliminated and access to the two lots will be from Sapphire Street N.W. Dedication of Streets. Drainage and Utility Easements. Street, drainage and utility easements shall be dedicated to the CITY as shown on the Final Plat. II. GENERAL: Park Dedication. Park dedication shall be satisfied by the DEVELOPER paying to the CITY the sum of One Thousand Five Hundred Ninety-six and 0/100 Dollars ($1,596.00) which amount represents 7% of the market value of the subject property. _'rr~f~ Disease Prevention. The DEVELOPER shall prevent the introduction and spread of tree disease into the residue tree populations of the Plat and adjoining properties and reduce the impacts of construction on the residual property of the Plat and adjoining properties. The DEVELOPER in order to accomplish this shall: Install physical barriers such as snow fence around trees that are to remain (the fencing will be at least ten feet (10') from the remaining trees; bo Insure that all equipment operators will have readily available tree wound dressing and will apply immediately to damaged trees if wounding occurs; Insure that trees will only be skidded against other trees that are to be removed. Trees in the middle twenty feet (20') of road easement will be removed first, with remaining trees to be removed to be skidded toward the middle of the road easement. Dumping of Garbage. The DEVELOPER shall adhere to City Ordinance No. 89- 11 which is an Ordinance Regulating the Dumping of Garbage, Site Development and Construction Debris.
