Mr. Banwart explained that the request by Mr. Kurak is for the rezoning of prope~, located north and east of the intersection of Highway 10 and Armstrong Boulevard from I-1 Industrial to B-1 Business, which is a higher and best use for this properly. A public hearing was held on June 6, 1989. No writ'ten or oral comments were received from the public. Motion by Commissioner Hendriksen, seconded by Commissioner LaDue, to approve the findings of 1act. Motion carried. Voting Yes: Chairman Zimmerman, Commissioners Ter~,, LaDue, Hendriksen and Shumway. Motion by Commissioner LaDue, seconded by Commissioner Shumway, to recommend to the City Council for approval of the rezoning request submitted by Tom Kurak for properb,, approximately 25 acres, at the north/east intersection of Highway 10 and Armstrong Boulevard from t-1 Industrial to B-1 Business. Case #3: Report status of request for ConditionaJ Use Permit to expand Ramsey Auto; case of Robed and Louis Wojcik. Chairman Zimmerman stated that a public hearing was held on this request and t~e Commission received comments 1rom adjoining property owners. He asked if the entrance location to Highway 56 has been determined. Mr. Banwart explained that the origi,~al Conditional Use Permit for this property indicated there would be an entrance only access. Currently customers park on Highway 10 or use the Highway 10 driveway which causes congestion. He pointed out that signs can be used to facilitate better traffic movement. He also suggested that off-street parking be required. The Commission directed stc. ff to veri,%., the location of the entrance. Commissioner Hendriksen stated that there are several instances in Ramsey where the stipulations for a Conditional Use Permit are repeatedly in violation, and it is difficult for the City to enforce since a good faith effort, is not being made by the applicant. Motion by Commissioner Hendriksen, seconded by Commissioner Terry, to dir~ the City Attorney to investigate wordage that can be added to future Conditional Use Permits which places a pedormance bond, deposit, special assessment against the propeR,, or monitory insurance in the City's hands to cover expenses incurred 1or enforcement of the Permit, with this report coming before the Commission for their recommendation to Council.
