insure tho! the City is not covering expenses 1or non-compliance. <br /> <br />Commissioner Shumway stated that the majority of Conditional Use Permits are in compliance <br />so he cannot agree to requiring an additional tee because it will, in essence, a~ as s penalty. <br />He stated that he will support, the motion since it includes the possibility of using an <br />assessment against the prope~' if a violation occurs, so only violators are penalized. <br /> <br />Commissioner LaDue stated he feels Conditional Use Permits are self-monitoring. Hz- pointed <br />out that if they are in violation they voluntarily destroy the special use and cancel the permit. <br />The matter can then be handled through the legal system. Commissioner Hendriksen pointed <br />out that because of the lengthy process involved with enforcement and litigation, there is <br />currently ne incentive for the applicant to stay in compliance. <br /> <br />Motion carried. Voting Yes: Chairman Zimmerman, Commissioners Hendriksen, Shumway, <br />Terry and LaDue. Voting No: None. Absent: None. <br /> <br />Case #4: Request for sketch plan review of Alicia Addition; case of Mr. Thomas Opsaht. <br /> <br />Mr. Banwart stated the request received from Thomas Opsahl 1or Alicia Addition includes 14 <br />single lamily residential lots with an average gross density of 2.86 acres and a net density of <br />2.5 acres. Two lots will share a joint access, which is being applied for from the County. <br />issues concerning grading will be discussed at a joint meeting between staff and the <br />developer. <br /> <br />The Commission proceeded to review the City Engineer's letter dated June 6, 1989. It was <br />noted that the Engineer is recommending that provision be made to provide for construction <br />of future streets to the east and south. Discussion of possible street alignments. <br />Commissioner Shumway recommended that Rabbit Street be extended to the southern <br />boundaw of the property and that 171st Avenue be extended to the easterly boundary. <br /> <br />Mr. Opsahl, the applicant, asked if cul-de-sacs would be required. Commissioner LaDue stated <br />that temporary cul-de-sacs should be installed. <br /> <br />Motion by Commissioner Shumway and seconded by Commissioner Terry, to approve the <br />sketch plan 1or Alicia Addition as submitted by Mr. Thomas Opsahl contingent upon the <br />continuation of both streets so 'they touch the propeR, lines and end in cul-de-sacs. <br /> <br />Commissioner Terr7 suggested to the applicant that he contact the adjoining prope~., owners <br />to find out what their future plans are. Mr. Opsahl stated that the property to the south and <br />e~st is not 1or sale. Mr. Banwart informed the Commission of recent action by the Metropolitan <br />Council which may limit development in Ramsey. <br /> <br />Chairman Zimmerman informed the applicant that the Commission will consider lot size <br />variances, if necessan/, to allow for 14 lots. <br /> <br />Motion carried. Voting Yes: Chairman Zimmerman, Commissioners Shumway, Terry. and <br />LaDue and Hendriksen. Voting No: None.
