Thc proposed <br />subdivision consists of one block, consisting of four (4) lots. This subdivision is bcin.~ considcrcd as a minor <br />subdivision. The total acreage is 26.2~ acres. The existing land use is Rural Residenttal/Agricultural use. Thc <br />future land use is anticipated to remain the same. Gordon for the proposed Gordon's <br />Garden's 2nd Addition. <br /> <br />At the May 2, 1989 Planning and Zoning Commission meeting, l,&. Harley Gordon stat~ that in his discussions <br />with Anoka County Department of Transportation the)' indicated that the upgrading of an existing access from <br />Count)' Road #22 for the proposed Lots 1 and 2 was acceptable. However, they had reservations about allowing an <br />additional driveway access from County Road #22 to Lot 3. Ratiner, Anoka County would prefer the extension of <br />180th Avenue Northwest to gain access to Lot 4, Block 1. Anoi:a Count)' has also stated that if access cannot be <br />obtained from 180th Avenue Northwest to Lot 4, Block 1, they would consider an additional driveway access from <br />Coumy Road #22. <br /> <br />On May 2, 1989, the Ramsey Planning and Zoning Commission requested the City Attorney to determine the <br />feasibility and cost responsibility of condemnation to extend 180th Avenue Northwest and then to obtain City <br />Council direction on same. The City Attorney adv/ses that eminent domain is most likel)' ar. ceptable and the public <br />purpose re4uirements can be met by showing the necessi.,?' of the road in allowing for the best and highest use of the <br />land. Furthermore, the City Attorney's opinion is the costs incurred for the eminent domain procedure should be <br />borne by the benefitting developer. According to Mr. Fa~,riey Gordon, the asking price for the segment of land n~dcd <br />to extend 180th Avenue Northwest was stated to be six thousand dollars (S6,000.00). The cost of eminent domain <br />could likely approach that mount. However, the negotiated purchase of the needed land considering vacation of a <br />portion of the existing cul-de-sac could be substantial)' less. <br /> <br /> <br />
