regarding the proper management for disease control. It is my understanding that this did not <br />occur and that finally the Minnesota Pollution Control Agency issued a burning permit. In both <br />of the above situations, there is no written responses from Mr. Gorecki nor were there any <br />signed agreements. <br /> <br />In the first quarter of 1989, I personally talked with Mr. Gorecki and stated that the operation <br />at 14140 Azurite Street N.W., due to the nature of the business, should have a Conditional Use <br />Permit. <br /> <br />On May 30, 1989, Benedict Gorecki, property owner of 14140 Azurite Street N.W. was sent a <br />certified letter stating that the City had observed that wood had been piled up on the property <br />and that the property was zoned industrial. According to City Code 170.016 I-Industrial <br />District, this is not a permitted use without first obtaining a Conditional Use Permit. The letter <br />also stated that the wood must be removed by June 15, or appropriate legal action would be <br />taken. The letter also stated that an alternative would be to apply for a Conditional Use Permit. <br />The letter also stated that if there were any questiOns regarding this matter that they could call <br />the Ramsey City Hall. <br /> <br />On June 5, 1989, I received a phone inquiry from Steve Gorecki regarding the May 30, 1989 <br />letter. A letter was sent to Benedict Gorecki dated June 5, 1989 stating the City's position why <br />a Conditional Use Permit would be required. Another letter was sent to Carol Daloski of Outside <br />Services, Inc. on June 16, 1989. This letter was the same as the June 5 letter sent to Mr. <br />Benedict Gorecki. <br /> <br />No further verbal or written responses were received by the Goreckis regarding these letters. <br /> <br />On August 9, 1989, City Staff contacted the City Attorney and requested legal action be brought <br />regarding non-compliance to City's request for a Conditional Use Permit. <br /> <br />On October 5, 1989, the City Attorney entered into a complaint with District Court Criminal <br />Division. The complaint specified problems of diseased wood. A court date was set in mid- <br />October. Two (2) days prior to the arraignment (pleading guilty/not guilty) City Staff (City <br />Administrator, City Attorney and Community Development Director) met with Benedict and <br />Steve Gorecki. The outcome of this meeting was that the City would request a postponement of <br />the arraignment and schedule this case before the City Council for review for the need of the <br />Conditional Use Permit for wood processing and storage at 14140 Azurite Street N.W. The <br />complaint would also be modified to include the need for a CUP. <br /> <br />On October 20, 1989 Bruce Bacon, Environmental Specialist, reviewed the site for possible <br />infractions regarding the City's disease control ordinance. His memorandum states that although <br />the oak and elm were dormant as far as spreading new infections, there was evidence that pieces <br />of red oak in the pile had old oak wilt spore mats which would require removal by April 1st, and <br />that a thorough investigation of other tree disease hazards would require a piece-by-piece <br />assessment. The memorandum also indicated that Mr. Gorecki would not estimate what the <br />origin or disease infestation of the wood was. <br /> <br /> <br />
