November 7, 1989

city Council
Ramsey, Minnesota

Re:

State of Minnesota v. Benedict Gorecki
Case No. K2-89-011475
Violation of Ramsey City Ordinance 170.015F

Dear Council Members:

Outside Services, Inc. is operating the business of landscaping,
tree maintenance and firewood from the property in question.
Outside Services leases the property from Benedict Gorecki. In
the operation of this business, it is necessary to have supplies
of crushed rock, black dirt, landscape woodchips, saw logs,
drying firewood, as well as firewood ready for market including
bundled firewood.

Benedict Gorecki received the enclosed letter dated May 30,
1989. The second letter was received dated June 30, and in
October, he was served with the enclosed Complaint.

The firewood portion of the business has been in existence there
since 1983. I am sure the Council understands that firewood has
to dry for a period of a year to two or three. In this particular
operation, those trees taken by the business which are smaller
than 6 inches are processed into woodchips; the logs larger than
6 inches are cut into 16-inch pieces, then piled and allowed to
#dry out" or season for a period of one to two or three years,
depending on their size, after which time they are ready for
market. This is the process that has been going on at this
particular property since 1983. It is a very material part of the
business and it is not "debris, refuse or garbage." As you will
note in the Complaint, it speaks of ~raw wood products in an open
area not properly contained or stored." I have no idea what is
meant by that because obviously this firewood has to be stored
outside and I know of no regulations which were in place prior to
the adoption of the ordinance apparently referred to. The area is
enclosed within a six-foot cyclone fence. Enclosed for your
information is a copy of the consent of neighbors which speaks
for itself, that this is not considered distasteful by any of the
neighbors.
