CASE <br /> <br />NUDITY ORDINANCE CONSIDERATION <br />By: Michael Auspos, Chief of Police <br /> <br />Background: <br /> <br />Two on-sale liquor establishments in the City have recently had "striptease" types of entertainment. <br />One of them, Jimmy B's, has it on a regular basis and J.R.'s had one presentation and, I was told <br />by the owner, Jim Gilbertson, they will not be having anymore. At the present time the City has <br />no ordinance regulating nude dancing display or other such activities. Such statutes only regulate <br />lewd and lascivious conduct which does not address simple nudity and for the most part applies to <br />minors. <br /> <br />The Council has been presented with two memos regarding this subject (See attachments). Since <br />the time of these memos, the Police Department has been asked by the Elk River Police Department <br />for information on our ordinances and policies regarding nude entertainment as one of their <br />establishments is starting up a show. <br /> <br />Observations: <br /> <br />At my request, plain clothes officers from the County attended two of the nude performances at <br />Jimmy B's. They reported there was no customer contact with the performers and with the <br />exception of pelvic gyrations and self-fondling of the breasts, there were no sexual act simulations <br />and no performer-to-performer contacts. It appears that the information from Elk River does to <br />some degree, confirm the suspicion that such activities can and will escalate into a "bar-wars" <br />competitive struggle for the customer dollar and perhaps increasing "varieties" of entertainment. <br /> <br />Recommendation: <br /> <br />The Council should decide whether or not to regulate by ordinance this particular form of <br />entertainment, especially if it is perceived to be in the public interest to do so. <br /> <br />Review Checklist: <br /> <br />City Administrator X <br />City Attorney X <br />City Engineer <br />Con-mnunity Development Director X. <br /> <br />/jmt <br /> <br />Chief of Police <br />Finance Officer <br />Planning & Zoning Comm. <br />Park & Recreation Comm. <br /> <br />X <br /> <br /> <br />
