CASE # 7 <br /> <br />REQUEST 'FO REZONE THE PROPOSED PLAT OF TOOTiI ACRES ADDITION <br />FROM I-1 INDUSTRIAL TO R-1 RURAL RESIDENTIAL; <br /> CASE OF JAMES gl. MARTIN <br /> By: Planning Assistant Sylvia Frolik <br /> <br />Background: <br /> <br />On September 22, 1989, the City received an application for rezoning from Mr. James Martin. <br />Mr. James Martin owns approximately 108 acres of land south of Hwy. ~i0 N.W., east of Alpaca <br />Estates. The northern portion of the property is currently zoned I-1 Industrial and the southern <br />portion is zoned R-1 Rural Residential. Mr. Martin is in the process of platting the southern <br />portion of the property with an addition to be named Tooth Acres. The proposed area of the <br />addition takes in a portion of the I-1 Industrial Zoning. Mr. Matin requested approval to rezone <br />wlmt is to be Tooth Acres to all R-1 Rural Residential zoning to accommodate development of <br />residential lots (21) on both sides of the street proposed to serve Tooth Acres. That area of the <br />property proposed not to be included in the Tooth Acres Addition would retain the I-1 Industrial <br />zoning. <br /> <br />On November 6, 1989, the Planning and Zoning Commission conducted a public hearing and there <br />were no verbal or written public comments submitted. The case was then tabled until December 4. <br /> <br />On December 4, 1989, Mr. Martin informed the Planning and Zoning Commission that in order to <br />satisfy the EQB and the intsnt of the Critical Rivers Ordinance, he would be reducing the numbzr <br /> ~n,~ property <br />of R-I Rural Residential lous to 15 single family lots and one outiot. The remainder of" '~ ~ <br />would be platted into four outlots with I-1 Industrial zoning.
