o <br /> <br />REZONING <br /> <br /> PROPOSED FINDINGS OF FACT <br /> TOOTH ACRES <br />FROM I-1 INDUSTRIAL TO R-1 RURAL <br /> December 5, 1989 <br /> <br />RESIDENTIAL <br /> <br />That James M. Martin, hereinafter referred to as "Applicant", has properly applied for a <br />reconfiguration of I-1 Industrial and R-1 Rural Residential zoning. <br /> <br />That the Applicant appeared before the Planning and Zoning Commission for a public <br />hearing pursuant to Section 170.013C of the City Code on November 6, 1989 and that said <br />public hearing was properly advertised and that the minutes of said public hearing are <br />hereby incorporated by reference. <br /> <br />That the property which is the subject of the application is legally described as follows: <br /> <br />That part of Lot 4, Auditor's Subdivision Number 34 in the Southwest Quarter of the <br />Southeast Quarter, and of the East Half of the Southwest Quarter of Section 28, Township <br />32 North, Range 25 West, and of Government Lots 1 and 2, Section 33, Township 32 <br />North, Range 25 West, Anoka County, Minnesota, described as follows: <br /> <br />Commencing at the point of intersection of the southwesterly line of U.S. Highway <br />Number 10 and a line drawn parallel with and 615 feet west, as measured at fight angles, <br />from the east line of said Southwest Quarter of the Southeast Quarter of Section 28; thence <br />South parallel with said east line of the Southwest Quarter of the Southeast Quarter and <br />parallel with the east line of said Government Lot 2 a distance of 1600 feet to *,he actual <br />point of beginning of the tract of land hereby to be described; thence West a distance of 66 <br />feet; thence North parallel with the fa'st course a distance of 1632.6 feet, more or less, to <br />the southwesterly line of said U.S. Highway Number 10; thence northwesterly along the <br />southwesterly line of said U.S. Highway 10 a distance of 2199.1 feet, more or less, to the <br />west line of said East Half of the Southwest Quarter of said Section 28, thence South along <br />said west line 1877 feet, more or less, to the southwest corner thereof; thence continuing <br />South along a line parallel with the east line of said Government Lot 1 of said Section 33, <br />158 feet, more or less, to the southerly line of said Government Lot 1; thence southeasterly <br />along the southerly lines of said Government Lots 1 and 2, to a point on a line drawn, <br />parallel with the east line of said Government Lot 2, Section 33, and distant West 615 feet <br />therefrom, as measured at fight angles; thence North parallel with the east line of said <br />Government Lot 2, Section 33, 600.5 feet, more or less, To the point of beginning. <br /> <br />ALSO: Tract A, R.EGISTERED LAND SURVEY NUMBER 53, files of the Register of <br />Titles, Anoka County, Minnesota. <br /> <br />That the subject property is approximately 108 acres in size. <br /> <br />Tl~,at the subject property is currently zoned I-1 Industrial and R-1 Rural Residential. <br /> <br />That the Applicant is proposing to reconfigure the current zoning on the property to create <br />55.7 acres of I-1 Indus~al zoning and 52.3 acres of R-1 Rural Residential zoning. <br /> <br />That the property to the east of the subject property is zoned R-1 Rural Residential; the <br />property to the west is zoned B-1 Business and R-1 Rural Residential; the property to the <br />north, across Hwy. 4/10 N.W., is zoned I-1 Induswial. <br /> <br /> <br />
