o 5) 6) PROPOSED FINDINGS OF FACT REZONING HEATHERWOOD HILLS R-1 RURAL RESIDENTIAL TO PLANNED UNIT DEVELOPMENT (PUD) 12/08/89 That Hokanson Construction, hereinafter referred to as "Applicant", has properly applied for a rczoning of Heatherwood Hills from R-1 Rural Residential to Planned Unit Development (P.U.D.). That the Applicant appeared before the Planning and Zoning Commission for a public hearing pursuant to Sections 170.013C and 170.016K of the City Code on December 5, 1989 and that said public hearing was properly advertised and that the minutes of said public hearing are hereby incorporated by reference. What the property, which is proposed to be named Heatherwood Hills, is legally described as follows: That part of the Northwest Quarter of the Northeast Quarter of Section 14, Township .32, Range 25 lying Westerly of the Westerly right-of-way line of State Trunk Hwy. No. 47 (aka St. Francis Blvd. N.W.) and lying Southerly of the South line of Duff and Towel Estates; except road; subject to easement of record; and That part of the Southwest Quarter of the Northeast Quarter of Section 14, Township 32, Range 25 lying Southwesterly of the centerline of T.H. No. 47; except road.; subject to easement of record; and That part of the Southeast Quarter of the Northeast Quarter lying Southwesterly of the centerline of T.H. No. 47 except road; subject to easement of record; and The Northeast Quarter of the Northwest Quarter of Section 14, Township 32, Range 25; except that part lying Easterly of the West line and it's Northerly extension to the North line of said Quarter/Quarter of Duff and Towel Estates; also except road; subject to easement of record; and The Southeast Quarter of the Northwest Quarter of Section 14, Township 32, Range 25 (Except g4550) ~xcept g4560) ('Except #4570) (Except ,~4540).
