iMPLE¥~ENTATION OF "4 IN 40 ZONING"
By: Merland Otto

Background:

As a condition of Metropolitan Council's (MC's) approval to expand
the MUSA, the City is reTaired to implement "4 in 40" acre zoning.
The City Council by Resolution #89-06-128 indicated to MC its
intent to implement "4 in 40" zoning.

As you may recall, the current zoning density policy for the rural
area is one dwelling unit per 10 acres based on the gross acreage
of the rural area with a minimum lot size of 2.5 acres. This
policy has allowed 2.5 lots to develop throughout much of Uhe City.

A cut off date of January 1, 1990 has been established such that
preliminary plats and PUD's which have City Council approval prior
to January 1 can develop under the current density policy. After
January !, the "4 in 40" policy will be in effect until such time
that MC revises its policy.

divided the City into five development districus. These are:

!)

Metropolitan Urban Se.~vice Area - Urban Density
Urban Reserve 10 Acre Min. Lot Size - 4/40 Density
Rural Transition Area - 2.5 Acre Min. Lot Size -
4/40 Density
Rural Service Area - !0 Acre Min. Lot Size - 4/40
Density
Mississippi Critical Rivers Area - 5A Min. Lot Size
4/40 Density

Dave Hart!ey and I met with MC staff on November 9, 1989 to review
the concept. We also have received info_~-mal MC staff comments
(11/27/89) and it appears to be acceptable.

On November 21, 1989 a public hearing was held by the P&Z
Coz~ission on the 4/40 zoning ordinance and amendments to the
com'Drehensive plan. Mr. Steve Schwanke, MC planner, attended.
~ile not popular, no objections were raised which would re~.~uire
substansiai or significan~ revisions to the proposed amendments.

Enclosed for your information are the following:

!)

MC editorial recently in "Metro Monitor" explaining MC's
position on "4 in 40".
Resolution 89-06-128 declaring City's intent to implement
"4 in 40" zoning.
Revised schedule for implementation of "4 in 40".
Excerpt from existing ordinance regarding R-IR densities.
