Case <br /> <br /> CONSIDER A2AENDING ORDINANCES <br /> REGULATING ~OURS OF OPERATION OF OFF-SALE <br />AI~D ON-SALE INTOXICATING LIQUOR ESTABLISHMENTS <br /> <br />By: William K. Goodrich, City Attorney <br /> <br />BACKGROUND: <br /> <br />Effective April 24, 1989, the Minnesota legislature expanded the <br />hours of operation ~or off-sale and on-sale liquor establishments. <br />The State now permits off-sale stores to be open on New Years Day, <br />January 1, and on Independence Day, July 4. <br /> <br />'The State now permits on-sale licensees to say open until 1:00 a.m. <br /> on Mondays whereas the closing time used to be 12:00 a.m. on <br /> Sundays. <br /> <br />Based on the language of our present ordinances on these subjects, <br />I gave the opinion that the expanded hours do apply to Ramsey, <br />since we incorporate State Statutes by reference in our ordinances. <br />This meant that our off-sale licensees could be open New Years Day, <br />January 1, 1990 and the on-sale licensees could be open until 1:00 <br />a.m. New Years Eve, 1989, which was a Sunday. The City does have <br />the option of being more restrictive on hours than the Sate law. <br /> <br />Therefore, does the Council agree with the new expanded hours or <br />would you desire to maintain the hours of operation as previously <br />adopted?
