Commissioner VanScoy was pleased that the applicant was already addressing the concerns of <br />the neighbors. He asked if Mr. Ariola had any other concerns with the conditions written into the <br />home occupation permit. <br />Mr. Ariola explained at times he used the business equipment for personal use, such as pushing <br />snow out of his driveway or leveling his property with the bobcat. He questioned if this would <br />be allowed, if not done during business hours. He stated he was having difficulty understanding <br />how to separate the use of his business equipment on his personal property. <br />Associate Planner/Environmental Coordinator Anderson indicated Code does not prohibit the use <br />of private property for home improvement projects. He suggested the applicant make the City <br />aware of potential future projects. <br />Development Services Manager Gladhill recommended the public hearing be closed at this time. <br />Motion by Commissioner Bauer, seconded by Commissioner VanScoy, to close the public <br />hearing. <br />Motion Carried. Voting Yes: Chairperson Levine, Commissioners Bauer, VanScoy, Brauer, <br />Field, Maul, and Nosan. Voting No: None. Absent: None. <br />Chairperson Levine closed the public hearing closed at 8:06 p.m. <br />Commission Business <br />Development Services Manager Gladhill summarized the findings and concerns expressed by the <br />adjacent property owners during the public hearing in detail with the Commission. These <br />findings will be included in the findings of fact forwarded to the City Council. Some of these <br />findings are already included. In these instances, the findings will be combined. In cases where <br />conflicts occur, the following findings entered into record shall replace the current draft. <br />Development Services Manager Gladhill indicated the City must react to evidence available at <br />this time, and rely on our code enforcement procedures if violations are confirmed in the future. <br />There are clearly some corrections to the existing business operation that must be completed <br />before final approval by the City Council. <br />Development Services Manager Gladhill noted adjacent property owners have expressed noise <br />concerns. He reported the City will monitor to ensure compliance with City Code Section 30 -3 <br />and will act upon evidence provided if violations are confirmed. <br />Development Services Manager Gladhill reported adjacent property owners have expressed <br />concern with safety device for rear movements on commercial vehicles. He indicated the City <br />cannot require the disconnection for certain vehicles and the applicant shall provide evidence of <br />compliance with State of Minnesota vehicle regulations. <br />Planning Commission /September 5, 2013 <br />Page 6 of 14 <br />
