CONTRACT <br />THIS AGREEMENT executed on this 12`h day of July 2009, by and between BETHEL <br />UNIVERSITY (1O-4411), a Minnesota nonprofit corporation under Minnesota Statutes chapter <br />317A (hereafter referred to as "BETIIEL UNIVERSITY") and PACT CHARTER SCHOOL, a <br />Minnesota nonprofit corporation under Minnesota Statutes chapter 3 ! 7A (hereafter referred to as <br />"PACT" or "PACT CHARTER SCHOOL"). See Attachment 1. This Contract shall be effective <br />from the date of approval by the Commissioner of the Department of Education or designee, <br />(hereafter referred to as Commissioner). <br />WHEREAS, the parties are authorized under Minnesota law to contract for the development and <br />management of a results -oriented School under Minnesota Statutes Annotated 1241110 (1997), <br />as amended, ("the Act"), and <br />WHEREAS, it is the parties' intent that PAC', at 7250 East Ramsey Parkway, Ramsey, MN <br />55303 ("the site"), operate a charter school under the Act; <br />NOW, THEREFORE, IT IS AGREED: <br />1 PURPOSE. <br />The purpose of this Agreement is to authorize and permit the Board of Directors of PACT to <br />organize and manage a results -oriented school consistent in all respects with the <br />Commissioner's action of April 12"`, 1994, authorizing negotiation of this Contract. <br />1.1 The overall purpose of PACT, as specified in Attachment 3, "Letter of Intent to Form <br />PACT" is to provide an educational program for its students in order to: <br />1.1.1 improve pupil learning; <br />1.1.2 increase learning opportunities for pupils; <br />1.1.3 encourage the use of different and innovative teaching methods; <br />1.1.4 establish new forms of accountability for schools; <br />1.2 PACT shall be nonsectarian in its programs, admission policies, employment <br />practices and all other purposes. <br />1.3 PA(:1' will not charge Minnesota residents tuition for admission to the school. <br />1.4 PACT shall not be used as a method of providing education or generating revenue for <br />students who are being home schooled. <br />2 TERM OF CONTRACT. <br />The term of this Contract is 5 years, commencing July IS`, 2009 and ending June 30111, 2014. <br />This Contract may be renewed or renegotiated by agreement of both parties, <br />3 AMENDMENTS. <br />The Contract may not be amended absent written agreement executed by both parties and <br />properly authorized. If the authority of PACI', as operator, or BETHEL UNIVERSITY, as <br />Authorizer, is altered by legislative act, this Contract is automatically modified to conform to <br />the new law.
