10 HEALTH AND SAFETY, HUMAN RIGHTS, AND STUDENT DISMISSAL <br />GUIDELINES. <br />PACT Charter School will comply with State and Federal health and safety, human rights, <br />and student dismissal laws, as applicable to charter schools: <br />10.1 Meet health and safety requirements; <br />10.2 Minnesota Statutes section 121 A.15, requiring proof of student immunization. <br />10.3 The Minnesota Human Rights Act, Chapter 363. <br />10,4 The Minnesota Pupil Fair Dismissal Act (MPFDA), Minnesota Statutes section <br />121 A.40 to section 121 A.56. PACT Board of Directors shall maintain a discipline <br />policy and procedure consistent with MPFDA . <br />10.5 The Minnesota Public Schools Fee Law, Minnesota Statutes section 123B.34 to <br />section 1238.39. <br />10.6 PACT shall not discriminate on any basis prohibited by state or federal law. <br />10.7 Minnesota Statutes section 121 A.04, to provide equal opportunity in athletic <br />programs. <br />10.8 Minnesota Statutes section 125A and section 124D.10, and rules relating to the <br />education of pupils with a disability. <br />10.9 Minnesota Statutes, Section 1241).10 subd. 6 (10) to provide certain data to the <br />Commissioner including a description of the financial parameters within which <br />PACT will operate to provide special education instruction and services to such <br />children. <br />11 OTHER MANDATES. <br />PACT will develop policies for and train staff and students, as appropriate, on the legal <br />requirements applicable to PACT including, but not limited to, non-discrimination, student <br />discipline, pupil fees and other state requirements. PACT will contract with legal counsel or <br />other providers for policy development, review and training as needed. <br />12 LENGTH OF SCHOOL YEAR. <br />PACT shall provide instruction each year as approved by the Board of Directors annually, in <br />compliance with State law. <br />13 INSURANCE. <br />Notwithstanding anything to the contrary in this Contract, PACT CHARTER SCHOOL shall <br />be considered a school district for the purposes of tort liability under Minnesota Statutes <br />chapter 466. PACI' shall acquire and keep in full force and effect such insurance as is <br />required to insure said liability and shall provide proof of insurance to the Commissioner. <br />Sec Attachment 6. <br />14 PROPERTY OWNERSHIP. <br />14.1 Upon termination of this Contract, and in the event of subsequent dissolution of <br />PACT CHARTER SCHOOL, all property that it might lease, borrow or contract for <br />use shall be promptly returned to those organizations or individuals from which <br />PACT has leased or borrowed the materials. <br />14.2 All property that has been purchased by or donated to PACT will remain its own.
