Draft Rules Commentary <br />ordinances; <br />(2) evaluate local government actions and overall <br />implementation and enforcement of Mississippi River <br />Corridor Critical Area ordinances to ensure compliance <br />with the state's minimum standards and criteria; <br />periodically report to local governments on potential <br />deficiencies and achievements; <br />develop model plans; <br />develop materials for local governments to use in <br />educational and marketing efforts that encourage the <br />use of best management practices specified in parts <br />6106.0010 to 6106.0150; <br />(6) develop model mitigation measures or systems for <br />common conditions for local governments to use as <br />provided under subpart 17; and <br />develop training programs for parts 6106.0010 to <br />6106.0150 and for the use of model ordinances. <br />D. If, after review, the commissioner determines that a local <br />government has failed to adopt, administer, or enforce plans <br />and ordinances in substantial compliance with parts <br />6106.0010 to 6106.0150, the commissioner may: <br />(3) <br />(4) <br />(5) <br />(7) <br />(1) <br />adopt plans and ordinances for a local government <br />that has failed to do so as provided under subpart 11, <br />item G; <br />(2) appeal the actions of a local government to the courts <br />as provided under Minnesota Statutes, chapters 116G, <br />394, and 462, as applicable; <br />reduce or eliminate a local government's eligibility for <br />grant programs administered by the commissioner; <br />and <br />(4) initiate judicial proceedings to compel specific <br />performance by a local government of any duty <br />required under parts 6106.0010 to 6106.0150 or <br />under any plans and ordinances adopted according to <br />parts 6106.0010 to 6106.0150. <br />The commissioner may seek reimbursement from the local government <br />for any costs incurred to implement item D, subitem (1). <br />(3) <br />Subp. 7. Duties of Metropolitan Council. The Metropolitan Council <br />must: <br />A. incorporate the standards and criteria in parts 6106.0010 to <br />6106.0150 into the council's planning processes; <br />B. work with local governments and the commissioner to ensure <br />that the standards and criteria in parts 6106.0010 to 106.0150 <br />are being adopted and implemented; <br />Item D outlines options the DNR may use to <br />enforce local government compliance with <br />the rules. <br />Duties of the Met Council are described in this <br />subpart. The Met Council is responsible for <br />reviewing plans and ordinances and providing <br />recommendations to the DNR for approval of <br />plans and ordinances.
