Draft Rules <br />with parts 6106.0010 to 6016.0150, under the authority of <br />Minnesota Statutes, chapters 394 and 473. If a county has <br />adopted ordinances under this part: <br />(1) a township's plan and ordinances must be consistent <br />with or more restrictive than the plan and ordinances <br />adopted by the county in which the township is <br />located as provided under Minnesota Statutes, <br />chapter 394; <br />(2) a township must provide for administration and <br />enforcement of Mississippi River Corridor Critical Area <br />ordinances in a manner that is at least as effective as <br />the respective county's implementation; and <br />(3) a township may adopt a county's ordinances by <br />reference. <br />Subp. 10. Duties of other agencies. <br />An agency owning and managing lands within the Mississippi River <br />Corridor Critical Area shall manage the lands under the agency's <br />ownership consistent with parts 6106.0010 to 6106.0150. For purposes <br />of this subpart, "agency" means the Metropolitan Airports Commission, <br />University of Minnesota, National Park Service, United States Army <br />Corps of Engineers, Department of Natural Resources, Metropolitan <br />Council, Minneapolis Park and Recreation Board, Three Rivers Park <br />District, Department of Transportation, Anoka -Ramsey Community <br />College, watershed management organizations as established under <br />Minnesota Statutes, chapter 103B, watershed districts as established <br />under Minnesota Statutes, chapter 103D, or any other federal, state, or <br />local general or special purpose unit of government. <br />Subp. 11. Preparation, review, approval, and adoption of plans and <br />ordinances. <br />A. Within one year of notification from the commissioner under <br />subpart 5, local governments must prepare or amend plans <br />and ordinances and formally submit a draft of these <br />documents to the Metropolitan Council and the commissioner <br />for review. Local governments may propose ordinance <br />standards that are not in strict conformity with parts <br />6106.0010 to 6106.0150 as provided under items J and K. <br />Local governments may submit preliminary draft plans and <br />ordinances to the commissioner for informal review prior to <br />formal submission to the Metropolitan Council. Upon a formal <br />written request from the local government, the commissioner <br />may grant an appropriate extension of time when the <br />commissioner determines that the local government is making <br />a good faith effort to meet the submittal deadline. <br />B. Within 45 days of receiving draft plans and ordinances from <br />15 <br />Commentary <br />Township regulations must be at least as <br />restrictive as the counties they are in. <br />Since a county and township may have <br />concurrent or overlapping jurisdiction, a <br />township could adopt a county's ordinance by <br />reference. <br />This subpart describes the duties for all <br />special units of government or government <br />agencies.
