Draft Rules Commentary <br />local governments as provided under item A, the Metropolitan <br />Council must review the draft plans and ordinances for <br />consistency with regional objectives, parts 6106.0010 to <br />6106.0150, and Minnesota Statutes, chapter 116G; submit the <br />council's written evaluation, copies of the draft plans and <br />ordinances reviewed, and any other relevant materials to the <br />commissioner; and provide a copy of the submission to the <br />National Park Service. Upon a formal written request from the <br />Metropolitan Council, the commissioner may grant an <br />appropriate extension of time when the commissioner <br />determines that the Metropolitan Council requires more time <br />for review. <br />C. Within 45 days of receiving a written evaluation of draft plans <br />and ordinances from the Metropolitan Council as provided <br />under item B, or revised draft plans and ordinances as <br />provided under item D, the commissioner must review the <br />draft plans and ordinances to determine their consistency with <br />parts 6106.0010 to 6106.0150 and Minnesota Statutes, <br />chapter 116G. Upon completing the review, the commissioner <br />must take one of the following two actions and provide a copy <br />of the decision to the Metropolitan Council and the National <br />Park Service: <br />(1) approve the draft plans and ordinances by written <br />decision and notify the local government; or <br />(2) return the draft plans and ordinances to the local <br />government for modification, with a written <br />explanation of the need for modification as provided <br />under item D. <br />D. When the commissioner returns a draft plan and ordinances to <br />the local government for modification, the commissioner must <br />provide a written explanation of the deficiencies of the draft <br />plan and ordinances that need to be corrected by the local <br />government before the commissioner can approve the draft <br />plan and ordinances. Within 60 days of the receipt of the <br />commissioner's written explanation, the local government <br />must revise the draft plan and ordinances consistent with the <br />instructions of the commissioner and resubmit the revised <br />draft plan and ordinances to the commissioner. If requested <br />by the local government or the Metropolitan Council, a final <br />revision need not be made until a formal meeting has been <br />held with the commissioner on the draft plan and ordinances. <br />If, in the opinion of the commissioner, the local government is <br />making a good faith effort to complete the modifications in a <br />timely manner, the commissioner may grant an appropriate <br />extension of time. Upon receiving the revised draft plan and <br />ordinances from the local government, the commissioner shall <br />conduct the review as provided under item C. <br />16 <br />6106.0060 1 <br />
