Draft Rules Commentary <br />E. Within 45 days of receiving the commissioner's approval of a <br />draft plan and ordinances, the local government must adopt <br />the commissioner -approved draft plan and ordinances and <br />submit a copy of the final adopted plan and ordinances, with <br />evidence of adoption, to the commissioner, the Metropolitan <br />Council, and the National Park Service. Plans and ordinances <br />prepared according to this part become effective when <br />adopted by the local government or upon such date as the <br />commissioner may provide in the written order adopting the <br />plans and ordinances as provided under item G. <br />F. Local governments must enact, for lands within the Mississippi <br />River Corridor Critical Area, only those plans and ordinances <br />that have the written approval of the commissioner. Once in <br />effect, the local government must implement and enforce the <br />commissioner -approved plans and ordinances. <br />G. If a local government fails to prepare and submit a draft plan <br />and ordinances within one year of notification as provided <br />under item A, fails to incorporate modifications that are <br />acceptable to the commissioner as provided under item D, or <br />fails to adopt commissioner -approved plans or ordinances as <br />provided under item E, the commissioner must: <br />(1) prepare plans and ordinances in substantial <br />compliance with parts 6106.0010 to 6106.0150 within <br />90 days of the deadline for preparation or adoption of <br />plans and ordinances as provided under items A to E <br />or the end date of an extension of time approved by <br />the commissioner as provided under item D; <br />(2) conduct a public hearing as provided by Minnesota <br />Statutes, chapter 14, and other statutes as applicable; <br />(3) within 60 days of the conclusion of the public hearing, <br />adopt the plans and ordinances for the local <br />government's portion of the Mississippi River Corridor <br />Critical Area by written order; and <br />(4) give notice of the adopted plans and ordinances to the <br />affected local government, the Metropolitan Council, <br />and the National Park Service. <br />H. Plans and ordinances that have been adopted by the <br />commissioner apply and have the same effect as if adopted by <br />the local government and shall be administered and enforced <br />by the local government. At any time after the preparation <br />and adoption of plans and ordinances by the commissioner, a <br />local government may prepare or amend plans and ordinances <br />according to parts 6106.0010 to 6106.0150. When the plans <br />and ordinances are approved by the commissioner, they <br />supersede the plans and ordinances adopted by the <br />commissioner. <br />17 <br />
