Draft Rules <br />parties as provided under subitem (2). <br />(2) The local government or the Metropolitan Council <br />requesting the district boundary amendment must <br />give notice of the proposed district boundary <br />amendment to adjoining or overlapping local <br />governments, the Metropolitan Council, the <br />commissioner, the National Park Service, and property <br />owners in the area directly affected by the proposed <br />district boundary amendment and publish notice in an <br />official newspaper of general circulation in the area. <br />Upon receiving a complete request for a district <br />boundary amendment as provided under subitem (1), <br />the commissioner has 60 days to approve or deny the <br />request or return the request for modification. <br />(4) The commissioner must consider the request and all <br />items submitted under subitem (1) and must, by <br />written decision, approve or deny the request or <br />return the request for modification. The decision must <br />include findings that address the consistency of the <br />proposed district boundary amendment with the <br />purposes of parts 6106.0010 to 6106.0150. <br />C. This subpart does not apply to the river corridor boundary <br />established by Executive Order 79-19. <br />(3) <br />PART 6106.0090 USES <br />Subpart 1. Underlying zoning. Uses permissible within the Mississippi <br />River Corridor Critical Area shall generally be guided by the local <br />government's underlying zoning, with additional provisions for certain <br />uses as specified by this part. <br />Subp. 2. Agricultural use. Where agricultural use is allowed by the local <br />government, perennial ground cover is required within 50 feet of the <br />ordinary high water level and within the bluff impact zone. Within the <br />slope preservation zone, a local government may allow row crops <br />subject to a conservation plan approved by the soil and water <br />conservation district board. <br />Subp. 3. Feedlots. New animal feedlots and manure storage areas are <br />prohibited. Existing animal feedlots and manure storage areas must <br />conform to the standards in chapter 7020. <br />Subp. 4. Forestry. Where forestry is allowed by the local government, <br />tree harvesting and biomass harvesting within woodlands, and <br />associated reforestation, must be conducted consistent with <br />recommended practices in Conserving Wooded Areas in Developing <br />Communities, Best Management Practices in Minnesota, incorporated <br />by reference under part 6106.0070. <br />25 <br />Commentary <br />This part describes how uses are regulated. <br />With a few exceptions, uses are regulated by <br />a local government's existing or underlying <br />zoning. <br />Subparts 2 — 6 describe five uses with special <br />considerations. <br />6106.0090 1 <br />
