Draft Rules Commentary <br />(1) not be readily visible when reasonable and consistent required. <br />with the purpose of the facility; <br />(2) comply with the dimensional standards and <br />requirements in parts 6106.0100 and 6106.0120, <br />unless no reasonable alternative exists; <br />(3) comply with the land alteration and storm water <br />management requirements in part 6106.0140; <br />(4) avoid primary conservation areas, unless no <br />reasonable alternative exists. If no reasonable <br />alternative exists, then design and construction must <br />minimize impacts to the greatest extent practicable; <br />(5) minimize disturbance of spawning and nesting times <br />by scheduling construction to be undertaken at times <br />when local fish and wildlife are not spawning or <br />nesting, respectively; and <br />(6) comply with items B to G. <br />B. A local government may allow public water access facilities, <br />including a public water access ramp, access paths, water - <br />oriented parking areas, and stairways, lifts, and landings, <br />subject to the following requirements: <br />(1) a watercraft access ramp must comply with chapters <br />6115 and 6280; <br />(2) access paths must comply with the land alteration and <br />storm water management requirements in part <br />6105.0140; <br />(3) water -oriented parking areas and approach roads <br />must not be placed in the bluff impact zone, shore <br />impact zone, or slope preservation zone if other <br />reasonable placement alternatives exist; <br />(4) stairways, lifts, and landings must comply with subpart <br />3; and <br />(5) public water access facilities must be designed and <br />constructed consistent with the standards in the <br />Design Handbook for Recreational Boating and Fishing <br />Facilities, incorporated by reference under part <br />6106.0070. <br />C. Trails providing access to or views of the Mississippi River may <br />be placed within the bluff impact zone, shore impact zone, or <br />slope preservation zone if design, construction, and <br />maintenance methods are consistent with the best <br />management practice standards in Trail Planning Design and <br />Development Guidelines, incorporated by reference under <br />part 6106.0070.
