Draft Rules <br />Subpart 1. Bluff impact zone and slope preservation zone. <br />A. No structures, impervious surfaces, land alteration, intensive <br />vegetation clearing, or construction activities are allowed <br />within the bluff impact zone or the slope preservation zone, <br />except as provided in item B. <br />B. The following structures, impervious surfaces, and activities <br />are exempt from item A: <br />(1) <br />public bridges and approaches, railroad sidings, and <br />public and private roadways serving river -dependent <br />uses according to part 6106.0110; <br />(2) public recreational facilities according to part <br />6106.0110; <br />aboveground pumping stations for sewer lines, if the <br />stations are not readily visible; <br />(4) historic sites; <br />(5) public safety facilities and airfield pavements; <br />(6) shoreline facilities according to part 6106.0110, <br />provided no reasonable alternative exists; <br />rock riprap and retaining walls according to part <br />6106.0140; <br />(8) public transportation facilities according to part <br />6106.0110, subpart 2; <br />restoration projects sponsored and approved by a <br />resource agency or the local government; <br />(10) one access path, subject to part 6106.0110; <br />(11) stairways, lifts, and landings according to part <br />6106.0110, subpart 3; <br />(12) public signs, such as directional, interpretive, <br />educational, safety, or handicapped designation signs; <br />and <br />(13) row cropping, subject to a conservation plan <br />approved by the soil and water conservation district <br />board. <br />(3) <br />(7) <br />(9) <br />Subp. 2. Development on steep slopes. A local government may allow <br />structures, impervious surfaces, land alteration, intensive vegetation <br />clearing, or construction activities on steep slopes when the following <br />conditions are met: <br />A. the applicant can demonstrate that the development can be <br />accomplished without increasing erosion or storm water <br />runoff according to part 6106.0140; <br />B. the soil types and geology are suitable for the proposed <br />development; and <br />C. vegetation is managed according to part 6106.0130. <br />35 <br />Commentary <br />Structures, impervious surface, land <br />alteration and intensive vegetation removal <br />are prohibited on slopes of 18% and greater <br />(i.e. in and near very steep slopes and bluffs). <br />MS 116G.15 requires the protection of bluffs <br />and very steep slopes. <br />Item 8 identifies exceptions to the <br />prohibitions in item A. <br />Development is permitted on slopes between <br />12% and 18% with the listed conditions. There <br />are no conditions for development on slopes <br />less than 12%. <br />6106.0120 <br />
