Draft Rules <br />B. meet or exceed the wetland protection standards under <br />chapter 8420; and <br />C. meet or exceed the floodplain management standards under <br />chapter 6120. <br />Subp. 2. Land alteration. <br />A. Within the shore impact zone, grading, filling, and land <br />disturbance activities involving a volume of more than ten <br />cubic yards of material or affecting an area greater than 250 <br />square feet require a permit from the local government and <br />must comply with subpart 3, with the following exceptions: <br />(1) emergency situations as determined by the local <br />government; and <br />(2) restoration projects sponsored or approved by a <br />resource agency or the local government <br />B. Within the bluff impact zone and slope preservation zone, <br />grading, filling, and land disturbance activities are prohibited, <br />with the following exceptions: <br />(1) aggregate mining and extraction subject to subpart 3 <br />and as provided under part 6106.0090, subpart 5; and <br />(2) development allowed as exceptions under part <br />6106.0120, subpart 1, subject to subpart 3. <br />Subp. 3. Erosion and sediment control. <br />A. Temporary and permanent erosion and sediment control is <br />required for any development that disturbs a total land <br />surface area of 3,000 square feet or more. <br />B. Temporary and permanent erosion and sediment control <br />measures must be consistent with Protecting Water Quality in <br />Urban Areas Manual, incorporated by reference under part <br />6106.0070, and must comply with the standards provided in <br />the National Pollution Discharge and Elimination System <br />(NPDES) Program permit for construction storm water. <br />Subp. 4. Rock riprap and retaining walls. <br />A. Placement of riprap and retaining walls below the ordinary <br />high water level requires a permit from the commissioner and <br />must comply with chapter 6115. <br />B. Within shore impact zones, bluff impact zones, and slope <br />preservation zones, a local government may allow by permit <br />constructing or replacing retaining walls, riprap, or other <br />impervious surfaces or using bioengineering techniques, <br />provided the following standards are met: <br />(1) retaining walls, riprap, or other impervious surfaces <br />must only be used for the correction of an established <br />38 <br />Commentary <br />Subpart 2 regulates grading and filling <br />activities in the shore impact zone (SIZ). Any <br />land disturbance greater than 250 square <br />feet in the SIZ requires an LGU permit. The SIZ <br />is the area within 50 feet of the ordinary high <br />water level. <br />Land disturbance is prohibited in the bluff <br />impact zone and the slope preservation zone, <br />subject to some exceptions. <br />This subpart outlines erosion and sediment <br />control measures. <br />Any activity that disturbs more than 3,000 <br />square feet requires temporary (construction) <br />control measures as well as permanent (post - <br />construction) control measures. <br />Provisions for hard armoring are described in <br />this subpart. <br />6106.0140 <br />
