Draft Rules <br />erosion problem that cannot be controlled through <br />the use of vegetation, slope stabilization using mulch, <br />a biomat, or similar bioengineering methods. This <br />determination must be done by a professional <br />engineer or person with certification in erosion <br />control; and <br />(2) design, construction, and maintenance must be <br />consistent with best management practices in <br />Protecting Water Quality in Urban Areas Manual, <br />incorporated by reference under part 6106.0070, or <br />other appropriate resource agency manual. <br />Subp. 5. Storm water management. <br />A. All development must meet or exceed the standards in <br />chapters 7050, 7053, and 7090, as well as the Metropolitan <br />Council's current water resources management policy plan. <br />B. The impervious surface coverage limit is determined by <br />underlying zoning. <br />C. Storm water practices must be designed to capture runoff <br />generated from one inch of rainfall over new or reconstructed <br />impervious surfaces. Where site conditions do not allow for <br />infiltration, other volume reduction practices or filtration <br />practices must be given priority. This item applies to any <br />development that requires a permit from the local <br />government that involves land alteration. Design, <br />construction, and maintenance must be consistent with The <br />Minnesota Stormwater Manual, incorporated by reference <br />under part 6106.0070. <br />PART 6106.0150 SUBDIVISIONS AND PLANNED UNIT DEVELOPMENTS <br />Subpart 1. General provisions. <br />A. Subdivision and planned unit development proposals must be <br />processed by local governments according to Minnesota <br />Statutes, chapters 394, 462, 505, and 515B. <br />B. Local governments must require detailed site information and <br />provide for preproject review of all proposed subdivisions and <br />planned unit developments as provided under part 6106.0060, <br />subpart 13. <br />C. The local government ordinances must contain provisions, <br />including incentives, for conservation subdivisions and <br />planned unit developments to protect primary conservation <br />areas and open space. <br />Subp. 2. Lot standards. <br />39 <br />Commentary <br />This subpart describes standards for <br />managing stormwater runoff. <br />The first inch of rainfall must be captured. <br />This part describes standards for subdivisions <br />and PUDs. <br />General requirements for subdivisions are <br />described in this subpart. <br />This item describes the type of information <br />local governments should use for reviewing <br />subdivision proposals.
