This Ordinance becomes effective upon its passage and thirty (30) days after publication according to law, subject to city Chapter Provision, Section 5.04. SECTION 2. AMENDMENT (1) PURPOSE AND POLICY It has been determined that improper waste storage, collection, transportation and disposal endanger the public health, safety and welfare, create public nuisances, result in scenic blight and adversely affect land values. Since this type of land use must meet or exceed the rules and standards established by the Minnesota Pollution Control Agency (MPCA), those same rules and standards must be met before a conditional use permit may be considered by the city Council. Additionally, performance standards must be met to assure that all conditional use permit requests will be reviewed using criteria that will prohibit land uses that endanger the public health, safety and welfare, create public nuisances, result in scenic blight or adversely affect land values, or create land use conflicts due to landfill operations and landfill related activities. (2) SCOPE In addition to the criteria outlined in Chapter 170.013D of the Ramsey City code pertaining to conditional use permits, these are rules and standards that regulate the issuance.of conditional use permits for storage, collection, transportation, treatment, utilization, processing, transfer, intermediate disposal, and final disposal of solid waste or processed waste product by any person and the issuing of conditional use permits for the construction and operation of solid waste disposal sites and facilities for the protection of the environment in keeping with Minnesota statutes, chapters 115, 116, 400 and 473D.
