This Ordinance becomes effective upon its <br />passage and thirty (30) days after <br />publication according to law, subject to <br />city Chapter Provision, Section 5.04. <br /> <br />SECTION 2. AMENDMENT <br /> <br />(1) PURPOSE AND POLICY <br /> <br /> It has been determined that improper <br />waste storage, collection, transportation <br />and disposal endanger the public health, <br />safety and welfare, create public <br />nuisances, result in scenic blight and <br />adversely affect land values. Since this <br />type of land use must meet or exceed the <br />rules and standards established by the <br />Minnesota Pollution Control Agency <br />(MPCA), those same rules and standards <br />must be met before a conditional use <br />permit may be considered by the city <br />Council. Additionally, performance <br />standards must be met to assure that all <br />conditional use permit requests will be <br />reviewed using criteria that will <br />prohibit land uses that endanger the <br />public health, safety and welfare, create <br />public nuisances, result in scenic blight <br />or adversely affect land values, or <br />create land use conflicts due to landfill <br />operations and landfill related <br />activities. <br /> <br />(2) SCOPE <br /> <br /> In addition to the criteria outlined <br />in Chapter 170.013D of the Ramsey City <br />code pertaining to conditional use <br />permits, these are rules and standards <br />that regulate the issuance.of conditional <br />use permits for storage, collection, <br />transportation, treatment, utilization, <br />processing, transfer, intermediate <br />disposal, and final disposal of solid <br />waste or processed waste product by any <br />person and the issuing of conditional use <br />permits for the construction and <br />operation of solid waste disposal sites <br />and facilities for the protection of the <br />environment in keeping with Minnesota <br />statutes, chapters 115, 116, 400 and <br />473D. <br /> <br /> <br />
